Motion carried. The public hearing was closed at 7:17 p.m. <br />Mayor Gamec called the regular portion of the City Council to order at 7:17 p.m. <br />Community Development Director Trudgeon stated the City Council had to hold a public <br />hearing because of the new agreement. This satisfies what the City Council. is asking for and <br />what the applicant is looking for. <br />Dave Perkins, 15775 Juniper Ridge Drive NW, stated he is the business owner and agrees with <br />the way it is being done now. <br />Councilmember Cook commented that this was a unique situation and we worked through it. <br />City Attorney Goodrich noted that #5 in the Resolution states "in the event of a subdivision of <br />the subject property, the Developer would be required to pay for the utilities". <br />Motion by Councilmember Cook and seconded by Councilmember Strommen to authorize the <br />business subsidy agreement with Dave Perkins Contracting. <br />City Attorney Goodrich noted the third motion recommended for Council and stated that the one <br />motion would take care of everything discussed. <br />The motion was withdrawn by Councilmember Cook and the second withdrawn by <br />Councilmember Strommen. <br />Motion by Councilmember Cook and seconded by Councilmember Strommen to adopt <br />Resolution 905-11-369 adopting Findings of Fact #0745 relating to the Business Subsidy <br />Agrecment with Dave Perkins Contracting. <br />:i lotion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Strommen, Elvig, Jeffrey, <br />Olson and Pearson. Voting No: None. <br />Council Business <br />Case 43: Request for Site Plan Review of Dave Perkins Contracting; Case of Dave <br />Perkins Contracting <br />Community Development Director Trudgeon stated that Council tabled the site plan of Dave <br />Perkins Contracting at the last meeting to this meeting to resolve the debate over the installation <br />of sewer and water underneath Limonite Street. It was decided by the Council that the City <br />would be responsible for the costs incurred to install sewer and water pipes underneath Limonite <br />`)'treet. This installation will also be paid for through the business subsidy agreement. <br />Motion by Councilmember Cook and seconded by Councilmember Olson to grant site plan <br />isapproval of the proposed site plan contingent upon compliance with City Staff Review Letter <br />City Council/November 7, 2005 <br />Page 6 of 16 <br />—21— <br />
