ou,:icilmember introduced the following resolution and.moved for its adoption: c-s RESOLUTION #05-11-XXX RESOLUTION APPROVING 1ST PARTIAL PAYMENT TO KOBER EXCAVATING 1NG. FOR PROJECT #02-40 OAK TERRACE ESTATES MOBILE HOME PARK, SANITARY SEWER, WATERIVIAIN AND STORM SEWER IMPROVEMENTS WHEREAS, on August 9"', 2005 the Ramsey City Council adopted Resolution #05-08- ?59 approving plans and specifications and ordering advertisement for bids for Oak Terrace 1 statcs Sanitary Sewer and Watermain; and WHEREAS, on September 27"', 2005, the Ramsey City Council adopted Resolution 'r05-09-340 awarding the contract for IP #02-40 to Kober Excavating Inc. in the amount of $44-7,486.05; and WHEREAS, Assistant Public Works Director/Principal Engineer, Brian Olson has inspected the completed work and recommends 15` partial payment to Kober Excavating Inc. in the amount of $106,380.98. NOON' THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IdANISEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1 j That the City Council hereby authorizes partial payment to Kober Excavating Inc. for Improvement Project #02-40 in the amount of $106,380.98. 2) That the City Council hereby accepts the project and authorizes the Mayor or City Administrator to sign the release form for this payment. 3) That the total amount of this payment is not included in resolutions approving payment of bills for the date of November 22, 2005. 4) That the City of Ramsey Yinance Department will be provided a signed copy of this resolution.
