Councilmember Cook expressed concern with setting a precedent if the applicant were not <br />required to pay for the sewer and water extension. He stated in the past several years there has <br />been a requirement that developers run the pipes beyond their development. <br /> <br />Counciimember Strommen noted the City agrees to pay for Mr. Perkin's sewer and water trunk <br />and lateral fees in the business subsidy, agreement. Clearly the intent is to pay for that type of <br />service, and to then charge Mr. Perkins for the additional sewer and water costs seems <br />inconsistent. Also, the language in the Staff Review Letter does suggest that the costs would be <br />paid by the City Engineering Depar{ment. .. <br /> <br />Councilmember Cook stated he agrees with Councilmember Strommen's argument, but they <br />need to be certain that this site does not negate anyone else in the City fi.om moving a pipe <br />beyond their development. He inquired about the possibility of showing extenuating <br />circumstances that make this site different. <br /> <br />City .Attorney Goodrich advised findings of fact may be necessary to show why a precedent is <br />m)t being set. <br /> <br />Mayor Gamec inquired if the City has purchased the other building from Mr. Perk/ns. <br /> <br />Mr. Perkins replied there is an agreement in place, but nothing has been finalized. He stated he <br />has invested a lot of time and money into this and these costs are coming Up at the last minute. <br /> <br />Councilmember Cook noted these costs should have been included in the TIF agreement as a <br />subsidy for the property. He inquired about the possibility of renegotiating the TIF agreement to <br />include these costs. <br /> <br />Assistant Public Works Director Olson replied the business subsidy agreement could be brought <br />back to the next Council meeting. ' <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Pearson, to table the Site plan for <br />Dave Perkins Contracting and direct staff to draft positive findings that include those items <br />unique to this project such that the City's payment of this sewer and water does not establish a <br />precedent, and in addition, review the business subsidy agreement to determine and accommodate <br />the payment of sewer and water service. <br /> <br />Further discussion: Councilmember Strommen asked what effect this motion will have on the <br />timeline. Assistant Public Works Director Olson replied it will be delayed to the next Council <br />meeting. Economic Development/TIF Specialist Sullivan advised a public hearing must be <br />c:alled on the subsidy agreement for the next Council meeting if the agreement will be changed. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Pearson, Elvig, and <br />Strommen. Voting No: None.
