In an g'ffdrt to alleviate some of these concerns, Mr. Guzzo agreed to store the boom truck off- <br />site. However, throughout this summer and fall, the City has received complaints on a regular <br />basis concerning the boom truck being parked at the property..'Furthermore, City Staff received a <br />complaint in September stating that the business activities seemed to be increasing and that there <br />was manufacturing occurring well past the permitted time of 5 pm. <br /> <br />Both the Planning Commission and City Council had some concerns regarding the compatibility <br />of this type of business in a residential area when Mr. Guzzo originally requested the Interim Use <br />Permit in April of this year. However, the Planning Commission and City Council were <br />concerned that denying that request may force the company out of business. Therefore, the City <br />Council approved a six (6) month Interim Use Permit to provide Mr. Guzzo an opportunity to <br />either restructure the business so that it complies with City Code or to relocate the business to a <br />commercial site. <br /> <br />Recommendation: <br /> <br />While the property is more than eight (8) acres in size, a large portion of it is located within the <br />floodway of Ford Brook, deeming much of the land as unbuildable. Thus, both the house and <br />accessory building are very near Green Valley Road, which creates a much smaller feel to the <br />property. The layout of the property is not really conducive to receiving large truck deliveries. <br />Furthermore, again because of the constraints of the property, all employee parking occurs in <br />front of the accessory building or in the driveway, which are both in clear view of Green Valley <br />Road. <br /> <br />While certain improvements have been made, such as the installation of an asphalt approach and <br />driveway, City Staff still does not think that this type of operation is appropriate for a residential <br />area. Furthermore, per City Council's direction back in May, the six (6) month IUP provided Mr. <br />Guzzo an opportunity to either demonstrate to the City that the business could fully comply with <br />the home occupation permit requh'ements or to relocate it to a commercial area. It was not until <br />late October that Mr. Guzzo met with City Staff to discuss what options he may have for <br />relocating to a TIF district with City assistance. At that meeting he was instructed to formulate a <br />proposal and then reconvene with City Staff; yet since that meeting, there has. not been any <br />further contact. <br /> <br />City Staff feels that the initial six (6) month Interim Use Permit provided adequate time to make <br />the appropriate adjustments or to relocate the business. If not for the notice that Staff sent Nh'. <br />Ouzzo in mid October, reminding him of the expiration date of the IUP, there most likely would <br />not have even been the initial meeting to discuss relocation options. Therefore, Staff would <br />recommend denying this request. <br /> <br />Commission Action: <br /> <br />Motion to recommend that the City Council adopt Findings of Fact relating to Robert Guzzo's <br />request for an interim use permit. <br /> <br />26 <br /> <br /> <br />
