CC Regular Session <br />Meeting Date: 11/22/2022 <br />By: Katie Schmidt, Administrative Services <br />Information <br />7.2. <br />Title: <br />Receive recommendation from the Charter Commission to amend the charter by Ordinance #22-29 under M.S <br />410.12, subdivision 7 <br />Purpose/Background: <br />The Charter Commission met on October 26, 2022 and is recommending the City Council amend the charter by <br />Ordinance #22-29 under M.S. 410.12, subdivision 7. The recommended ordinance is to amend Section 2.4 of the <br />Charter that no member of the Council may serve on the Charter Commission or other Board or Commission. The <br />language in Ordinance #22-29 is the same language as the recently passed Ordinance #22-17 (attached for <br />reference). <br />Within one month of receiving a recommendation to amend the charter by ordinance, the city must publish notice <br />of a public hearing of the proposal. The city must hold the public hearing on the proposed charter amendment at <br />least two weeks but not more than one month after the notice is published. Within one month of the public <br />hearing, the city council must vote on the proposed charter amendment ordinance. The vote must be unanimous, <br />including approval by the mayor. <br />The ordinance proposing the amendment is subject to the same publication requirements as other ordinances. The <br />ordinance becomes effective 90 days after passage and publication unless a later date is provided in the <br />ordinance. <br />State Statute 410.12 supersedes the City Charter ordinance requirements. There is no requirement to introduce the <br />ordinance. In this case it is required to receive the recommendation of Ordinance #22-29 from the Charter <br />Commission. <br />Notification: <br />• A Notice of Public Hearing will be published on Friday, December 16, 2022. <br />• The Public Hearing will take place on Tuesday, January 10, 2023. <br />Time Frame/Observations/Alternatives: <br />Next Steps: <br />• Within one month of the public hearing, the city council must vote on the proposed charter amendment <br />ordinance. Council may choose to vote on the ordinance after the Public Hearing has been closed or at the <br />January 24, 2023 meeting. <br />• If the City Council unanimously approves adoption of Ordinance #22-29, then the Charter amendment <br />would take effect 90 days after publication. If an affirmative vote is not received by all Council members, <br />the ordinance would fail. <br />
