1979490.012 <br /> <br />Councihnember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-09-334 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO EXCEED ACCESSORY BUILDING SQUARE FOOTAGE RESTRICTIONS AT 7960 <br />171st LANE NW BASED ON FINDINGS OF FACT AND DECLARING TERMS OF <br />SAME: <br /> <br /> WHEREAS, David and Lynette Randall (Permittee) have properly applied for a <br />conditional use permit to exceed the detached accessory building square footage restrictions <br />established in section 9.11.02 "Accessory Uses" of City Code on the property generally known as <br />7960 171st Lane NW and legally described as follows: <br /> <br />Lot 3, Block 1, Dellwood Hills, Anoka County, Minnesota <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on September 1st, 2005, conducted <br />the public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0740, a Conditional Use Permit (Permit) to exceed the detached <br />accessory building square footage restriction for said property as established in City Code, is <br />hereby granted to David and Lynette Randall, hereinafter referred to as the "Permittee" <br /> <br />2. That the new accessory building shall not exceed 1,200 square feet and the total accessory <br /> building space on the subject property shall not exceed 2,480 square feet. <br /> <br />3. That the construction of the detached accessory building on the Subject Property shall require <br /> issuance of a building permit from the City of Ramsey. <br /> <br />4. That the accessory building shall be properly constructed and maintained in accordance with <br /> all applicable Uniform Building Codes and local zoning regulations. <br /> <br />5. That thc Permittee herein agrees that no business use will be operated in the detached <br /> accessory building unless such use is permitted in accordance with the City Code. <br /> <br />6. That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br /> <br />
