Councilmember <br /> <br />introduced the following resolution and moved for its adoption: <br /> <br /> RESOLUTION #05-12-X~XX " <br /> <br />RESOLUTION AP. PROVING 2ND PARTIAL PAYMENT TO KOBER EXCAVATING <br />INC. FOR PROJECT #02-40 OAK TERRa, CE ESTATES MOBILE HOME <br />SANITARY SEWER, WATERMAIN AND STORM SEWER IMPROVEIYLENTS <br /> <br /> WHEREAS, on August 9th, 2005 the Ramsey City Council adopted Resolution #05-08- <br />259 approving plans and specifications and ordering advertisement for bids for. Oak Terrace <br />Estates Sanitary Sewer and Watermain; and <br /> <br /> WHEREAS, on September 27th, 2005, the RamseY City Council adopted Resolution <br />#05-09-340 awarding the contract for I[P #02-40 to Kober Excavating Inc. in the amount of <br />$447,486.05; and <br /> <br /> WHEREAS, Assistant Public Works Director/Principal En~neer, Brian Olson has <br />inspected the completed work and recommends 1st Partial payment to Kober Excavating Inc. in <br />the amount of $106,380.98: <br /> <br /> WH.EREAS, Assistant Public Works Director/Principal Engineer, Br/an Olson has <br />inspected the completed work and recommends 2nd partial payment to Kober Excavating Inc. in <br />the amount of $218,128.05. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Council hereby authorizes partial payment to Kober Excavating Inc. for <br />Impr3vement Project #02~40 in .the amount of $218,128.05. <br /> <br />2) <br /> <br />That the City Council hereby accepts the project and authorizes the Mayor or City <br />.Administrator to sign the release form for this payment.. <br /> <br />3) <br /> <br />That the total amount of this payment is not included in resolutions approving payment of <br />bills for the date of December 13, 2005. <br /> <br />4) <br /> <br />That the City of Ramsey Finance Department will be provided a signed copy of this <br />resolution. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br /> .., and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />and the following voted against the same: <br /> <br />and the following abstained: <br /> <br />and the following were absent: <br /> <br />RESOLUTION #05-12-XXX <br /> Page 1 of 2 <br /> <br />-205- <br /> <br /> <br />
