CASE # <br /> <br />REQUEST FOR AN INTERIM USE PERMIT TO ALLOW FOR MOTOR VEHICLE <br />SALES WITH AN OUTDOOR DISPL. AY AREA: <br /> CASE OF LUMAX, LLC <br /> By: Breanne Dalnes, Associate Planner <br /> <br />Background: Lumax, LLC has requested a conditional use permit to allow for motor vehicles <br />sales with outdoor display. The Council decided that an interim use permit would be more <br />appropriate for this particular site. <br /> <br />5 <br /> <br />The following items are enclosed for your information: <br /> a) Site location map .... <br /> b) Site Plan <br /> c) Proposed Findings of Fact <br /> d) Proposed Interim Use Permit <br /> <br />Observations: <br /> <br />Lumax, LLC originally applied for a conditionaI use permit to sell and display vehicles for sale at <br />the property located at 6246 Highway 10 NW. The site is zoned E-1 Employment and guided as <br />Places to Work in the Comprehensive Plan. The proposed use is only allowed by a conditional <br />use permit within this district. <br /> <br />The subject property and the surrounding a~eas were consciously guided for manufacturing or <br />industrial uses in the 2001 Comprehensive Plan. However, the existing building located on the <br />site is currently vacant, .and the site is generally underutilized. There is a collision center/auto <br />repair shop immediately adjacent to the site to the west, and a trailer hitch/car accessory shop <br />immediately to the east of the site. In the general area, there is a mix of manufacturing uses and <br />car service uses. <br /> <br />The Planning Commission reviewed the request on November 3, 2005, and recommended <br />denying the conditional use permit. <br /> <br />The City Council heard the request on November 22, 2005, and recommended granting an <br />Interim Use Permit, to allow for the temporary utilization of the property as a vehicles sales lot: <br /> <br />Recommendation: <br /> <br />City Staff recommends approval of an Interim Use Permit for the term of 2 years, renewable for <br />an additional 2 years, upon Commission and Council review. <br /> <br />Council Action: <br /> <br />Motion to adopt Resolution #05-11-XXX to adopt Findings of Fact #XXX to support the <br />granting of an Interim Use Permit to allow the motor vehicle sales with outdoor display on the <br />propetW at 6246 Highway 10 for a period of 2 years. <br /> <br />-346- <br /> <br /> <br />
