Councilmember XX_X~ introduced the following resolution and moved for its adoption: RESOLUTION #05-11-xxx A RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT FOR MOTOR VEHICLE SALES WITH OUTDOOR DISPLAY BASED ON FINDINGS OF FACT AND DECLARING TERMS OF SAME: WHEREAS, Lumax, LLC (Permit-tee) has properly applied for a Conditional Use Permit for the sales and outdoor display of vehicles, as permitted as a conditional use under 9.20.22 of City Code for the property legally described as Lot 10, Auditor's Subdivision #96, Except Road Subject to Easement of Record, Anoka County, Minnesota (Subject ProPerty) WHEREAs, the Planning Commission met on November 3, 2005, conducted the public hearing and recommended City Council denial of the request, and WHEREAS, The City Council met on November 22, 2005 and determined that the requested use may be acceptable in the short term and suggested that the Permittee consider an Interim Use Permit, and WHEREAS, the Permittee a~eed to convert the request for a Conditional Use Permit to an la~terim Use Permit. NOw THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY;'STATE OF MINNESOTA, as follows: Based on Findings of Fact #XXXX, a Interim Use Permit (Permit) for the sales and outdoor display of vehicles is hereby ganted to Lumax, LLC, hereinafter referred to as the "Permittee." 2. That the storage area is surfaced with concrete or bituminous. 3. That this use does not take up parking space or loading area as required for conformity to this chapter. 4. That this Permit shall be limited to a term of 2 years, renewable at the Planning Commission and Council discretion for an additional two years. 5. That the Permittee shall be responsible for all Cit3, costs incurred in administering and enforcing this Pe~rnit. -353-
