R. Violation of This Contract. If the DEVELOPER fails to perform any of <br />the terms of this Contract in the manner required by the CITY, the CITY shall be <br />entitled to recover, from the DEVELOPER or the issuer of DEVELOPER'S financial <br />guarantee, the full amount of any and all financial guarantees. Breach of any of the terms <br />of this Development Contract by the DEVELOPER shall also be grounds for denial of <br />Building Permits for buildings in the Plat. <br /> <br /> S. Contract Bindina On Successors and Assians. The DEVELOPER agrees <br />that this Development Contract shall be binding upon its successors and assigns. <br /> <br />26. Requirements for Buildin~ and Occupancy Permits. On November 22, 2005, the Ramsey <br /> City Council approved entering into an indemnification agreement that allowed Sharp and <br /> Associates to begin construction on the proposed building and associated improvements. If <br /> said idemnificaiton agreement is not executed by the DEVELOPER and Sharp and <br /> Associates, then the following shall apply: No building permit, for any lot in the Plat shall be <br /> issued until: (a) a Class 5 driving surface is installed to within 300 feet of the structure; (b) a <br /> Certificate of Survey, including that survey information required by the CITY has been <br /> supplied to the CITY Building Official; and (c) all the financial guarantees required by the <br /> CITY have been satisfied. (d) Permit from the Lower Rum River Watershed Management <br /> Organization has been obtained (e) Permit from Anoka County Soil Conservation District has <br /> been obtained[if necessary] (f) this Development Contract has been signed and received by <br /> the CITY. A footings and foundation permit for the structure has been released due to prior <br /> action of the Ramsey City Council. <br /> <br />No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the <br />lot is provided including the installation of at least one layer of bitumino~.ts surfacing; (b) all <br />utilities are in place, operational and accepted by the CITY; (c) for lots that have a slope of <br />less than 2%, a certificate of grading, pr~epared by a licensed (State of Minnesota), <br />professional land surveyor, must be provided to the CITY documenting that the flattest grade <br />on this lot is 1% or greater will require certificates of grading; and (d) boulevard sod and <br />landscape tree, or escrow for same, have been provided. <br /> <br />27. Parkland and Trail Dedication. The Subject Property is located-in the Greenland Hills <br /> District. In accordance with the Park and Trail Dedication Contract da~ed April 12, 2005, <br /> there is a park payment obligation due to the CITY in amount of Twnety Thousand Four <br /> Hundred and Five Dollars and no cents ($20,405.00) (4.081 units x $5000/acre). It is noted <br /> that the CITY has already received $6.4 million from RAMSEY TOWN CENTER, LLC in <br /> land and cash for for park and trail improvements within the Town Center project area, as <br /> outlined in the'Master Development Agreement. <br /> <br />Sidewalk Construction. The DEVELOPER shall construct and pave, in accordance with <br />CITY standards, a five (5) foot wide concrete sidewalk with pedestrian ramps in locations <br />prescribed by the CITY as shown on the final plat submittal dated November 11, 2005 and <br />as amended by City Staff Review, at a grade not to exceed 5%, <br /> <br />Ramsey Town Center llth Addition <br />Development Contract <br /> Page 9 of 11 Pages <br /> <br />-396- <br /> <br /> <br />
