CASE # <br /> <br />ADOPTION OF ORDINANCE FOR VACATION OF EASEMENT IN CLEMENS <br />SECOND ADDITION; <br /> CASE OF VINCENT CLEMENS <br /> By: Breanne Dairies, Associate Planner <br /> <br />Background: <br /> <br />The City Council approved the final plat of Clemens' Second Addition on November 22, 2005. <br />The 2® Addition was a re-plat of an outlot into a buildable lot, which included the standard <br />drainage and utility easements. These easements must now be vacated to ailoTM for the recording <br />of Clemens Second Addition, which, includes new drainage and Utility easements that will <br />supersede the original easements. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate easements. <br /> <br />Observations: <br /> <br />It takes a public hearing and Council ordinance to eliminate the underlying drainage.and utility <br />easements that exist as part of the original Clemens Addition plat. The ordinance was introduced <br />at the November 22, 2005 Council meeting and is now ready for adoption.- <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the enclosed ordinance to vacate existing easements. <br /> <br />Council Action: <br /> <br />Motion to adopt Ordinance #05-12__ <br />Addition. <br /> <br />to vacate certain drainage .and utility easements in Clemens <br /> <br />-470- <br /> <br /> <br />
