CASE # <br /> <br />ADOPTION OF ORDINANCE FOR VACATION OF EASEMENTS IN <br /> MINKS BUSINESS PARK; " <br /> CASE OF MINKS PROPERTIES, LLC <br /> By: Breanne Dalnes, Associate Planner <br /> <br />Background: <br /> <br />The City Council approved the final plat of Minks Business Park on November 22, 2005. The <br />minor subdivision is a lot combination, requiring the vacation of easements along the original <br />common property line. These easements must now be vacated to allow for the site plan to be <br />carried out as approved, and for the multi-tenant building to be constructed across the previous <br />easements. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />o) <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate .easements. <br /> <br />Observations: <br /> <br />It takes a public hearing and Council ordinance to eliminate the underlying drainage and utility <br />easements that exist as part of the original lots. The ordinance was introduced at the November <br />22, 2005 Council meeting and is now ready for adoption. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the enclosed ordinance to vacate ex/sting easements. <br /> <br />Council Action: <br /> <br />Motion to adopt Ordinance #05-12-__ <br />Business Park. <br /> <br />to vacate certain drainage and utility easements in Minks <br /> <br />Roll Call Vote: <br /> <br />Councilmember Olson <br />Councilmember Cook <br />Councilmember Jeffery <br />Councih'aember Pearson <br />Councilmember Elvig <br />Councilmember Strommerm <br />Mayor Gamec <br /> <br />-476- <br /> <br /> <br />
