CASE # <br /> <br />ADOPT AN ORDINANCE AMENDING,SECTION 9.11 <br />(PERFORMANCE STANDARDS) OF CITY CODE; <br />CASE OF CITY OF RAMSE'Y <br /> By: Chris. Anderson, Zoning & Recycling Coordinator <br /> <br />Background: <br /> <br />Earlier this year, the City received a building permit application for an ektefior solid fuel-fired <br />heating device (outdoor furnace). During the review progess of this application, City Staff <br />realized that there are no standards or regulations for these appliances in City Code. Due to their <br />potential to create a nuisance for neighboring properties, City Staff has drafted an ordinance to <br />establish some basic regulations for these devices.. <br /> <br />The following items are enclosed for review: <br /> a) Draft ordinance <br /> <br />Observations: <br /> <br />The proposed ordinance would establish minimum standards for exterior solid fuel-fired heating <br />devices including both a minimum setback from property lines and installation requirements. <br />These requirements aim to minimize the potential nuisances created by these appliances such as <br />smoke and/or cinders. ~ <br /> <br />The Planning Commission conducted'a public hearing for the proposed ordinance during their <br />regular meeting on September 1, 2005. There were no written or verbal comments submitted. <br />However, the Planning CommiSsion raised several concerns and directed Staff to revise the draft <br />ordinance accordingly, Staff incorporated those revisions into the proposed ordinance and <br />presented the draft to the Planning Commission at their-October 6, 2005. meeting. <br /> <br />City Council introduced the ordinance on October 25, 2005. During that meeting, the Fire Chief <br />did raise some concern with this proposed ordinance. Staff has conferred with the Fire Chief and <br />after reviewing the draft ordinance, the Fire Chief is satisfied that his concerns are addressed in <br />the proposed ordinance. In accordance with the City Charter, the ordinance is now eligible for <br />adoption. <br /> <br />Recommendation: <br /> <br />The Planning Commission and City Staff recommend adopting the-proposed ordinance. <br /> <br />Council Action: <br /> <br />Motion by Councilmember and seconded by Councilmember to <br />adopt the proposed ordinance amending City Code Section 9.11 (Performance Standards) to <br />establish regulations for exterior solid fuel-fired heating devices. <br /> <br />13 <br /> <br />-484- <br /> <br /> <br />
