CASE # ~ <br /> <br />CONSIDER AMENDING RESOLUTION AUTHORIZING ACQUISITION OF RIGHT-OF <br />WAY FOR THE IMPROVEMENT OF POTASSIUM STREET NW. <br /> <br />By: William K. Goodrich, City Attorney <br /> <br />Background: <br /> <br />In June of this year the Council authorized acquisition of right-of-way by eminent domain if <br />necessary for improvement of Potassium Street NW. Since that date, as a result of various other <br />Council actions and engineehng decisions, the width of the necessary right-of-way has changed. <br />The enclosed proposed Resolution provides for the minimum right-of-way width in order to <br />accommodate a 24 foot wide pavement and necessary utilities.. <br /> <br />Council will recall that a part of the Potassium Street right-of-way lies within wetlands. The City <br />has requested the LRRWMO to permit the Potassium Street pavement to be constructed within the <br />wetland thereby filling the associated wetland. It is anticipated that the LRRWMO will make a <br />decision on this request in February 2006. The attached Resolution seeks a righi-uf-way u£ 59 feet <br />on affected Parcels 3 and 4. In the event the LRRWMO permits encroachment into the wetland, <br />this right-of-way on these two parcels can be reduced to 38 feet. <br /> <br />Enclosure: <br /> <br />Proposed amended Resolution. <br /> <br />Recommendation: <br /> <br />Staff recommends adoption of the amended Resolution. <br /> <br />Motion: <br /> <br />Motion to approve Resolution 05-12- which is a resolution amending Resolution 05-06-__ <br />regarding the acquisition of right-of-way for Potassium Street. <br /> <br />Review Checklist: <br /> <br />City Administrator <br />Len Linton, Asst.
