CONSIDER RESOLUTION AUTHORIZING EMINENT DOMAIN IF NECESSARY FOR THE <br />ACQUISITION OF PERMANENT EASEMENTS FOR THE NORTHWEST SANITARY <br />SEWER PROJECT. '- <br /> By: William K. Goodrich, City Attorney <br /> <br />Background: <br /> <br />As Council' is aware, you have previously authorized the Northwest Sanitary Sewer Project and <br />acquisition of easements by direct negotiation. Approximately 11 trail and sewer easements have <br />been acquired with 19 still to be acquired. The Tinklenberg Group continues to negotiate with <br />property owners and is confident that several other easements can be acquired by negotiation. <br />However, in order to keep the project on schedule it is necessary to now commence the eminent <br />domain process. The attached resolution is for that purpose. You will note the resolution, as <br />required by State law does require formal appraisal of those easements which need to be acquired <br />by eminent domain as well as continued negotiation with the affected property owners. Rather than <br />attach the entire 30-some page Exhibit A, we are attaching to the resolution for the Council case a <br />summary of the property owners from whom we continue to seek easements. The full exhibit "A" <br />with the legal descriptions will be available at the Council desk and for public review at the Council <br />meeting. <br /> <br />The Council should also note receipt of a "petition to reject and oppose the City of Ramsey". The <br />petition "... gives notice that we reject and oppose the City's proposal to locate and construct a <br />walking/biking path across our properties".
