Brad Lano, applicant, stated he is the owner of this property. The property has been vacant for
six months, and there were trailer sales located on the property previously. The neighboring
property is Minnesota Hitch. He was not able to attend the Planning Commission meeting where
this was discussed. This is likely the primary use for this property, there is only an issue because
the zoning has been changed. This is a small parcel that lends itself nicely to auto, RV, motor
home, or trailer sales. This parcel sitting vacant does not help him or the City.

Councilmember Elvig commented he is not sure what else could be done with this site. The City
has been headstrong on cleaning up Highway 10, but this site is sandwiched between two
outdoor sales activities. He asked what the length is of the conditional use permit.

Ms. Frolik replied the conditional use permit does not expire. The Council could consider an
interim use permit, and the use would be reviewed periodically.

Councilmember Elvig expressed his preference for a sunset on the permit to allow for the
possibility for a new use with massing of the ground in this area. At this point he does not know
what else could be done with the property.

Mayor Gamec stated he would be more in favor of something like an interim use permit. This
property has been operated nicely and cleanly, and he would hope whatever use the site is rented
to would be controlled.

Councihnember Strommen indicated she would be in favor of the interim use approach as a
temporary solution to allow the property to be utilized. She stressed the need to be careful about
second guessing the Comprehensive Plan.

Councilmember Elvig asked the applicant if three years would be a reasonable time period for an
interim use permit.

Mr. Lano replied he would prefer four years.

Motion by Councilmember Cook, seconded by Councilmember Strommen, to table the request
for a conditional use permit to allow for motor vehicle sales with an outdoor display area, Case
of Lumax, LLC, and to direct staff to draft findings in favor of an interim use permit for the site.

Further discussion: City Attorney Goodrich asked if there are any 60 day rule issues that will be
affected by tabling this application. Ms. Frolik replied it is likely that the applicant would waive
the 60 day requirement. Mr. Lano responded that is correct.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Strommen, Elvig, Jeffrey,
Olson, and Pearson. Voting No: None.

Further discussion: Councilmember Jeffrey clarified the applicant will not need to reapply fbr a
permit and pay an additional fee. Ms. Frolik responded that is correct.

City Council / November 22, 2005
