Councilmember Musgrove introduced the following resolution and moved for its adoption: <br />RESOLUTION #22-249 <br />RESOLUTION APPROVING DEVELOPMENT AGREEMENT FOR RIVERSTONE <br />SOUTH SECOND ADDITION <br />RECITALS <br />1. Capstone Homes dba Riverstone Development, LLC hereinafter referred to as the <br />"Permittee" has an approved Preliminary Plat and associated Final Plat for Riverstone <br />South for the property legally described in Exhibit A (the "Subject Property"). <br />2_ That a contingency of approval for the Final Plat for Riverstone South included the <br />Permittee entering into a Development Agreement with the City. <br />3. That the City Council reviewed and approved the Development Agreement for Riverstone <br />South Second Addition on December 13, 2022. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the Ramsey City Council hereby grants approval of the Development Agreement (the <br />"Agreement") for Riverstone South Second Addition on the Subject Property contingent <br />upon the following conditions: <br />CONDITIONS <br />1. Final legal form approved by the City Attorney. <br />2. That the Permittee shall be responsible for all City costs incurred in administering and <br />enforcing this Agreement. <br />3. Review and approval by City Engineer and City Finance Department. <br />4. Approved Final Plat and associated contingencies. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Woestehoff, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Kuzma <br />Councilmember Musgrove <br />Councilmember Woestehoff <br />Councilmember Heineman <br />Councilmember Howell <br />Councilmember Riley <br />Councilmember Specht <br />
