Subd. 3 Additional Requirements. <br />a. Exterior solid fuel-fired heating devices shall be located at least seventy-five (75) <br /> feet from any property line and shall not be located in the front yard. <br /> <br />All exterior solid fuel-fired heating devices installed or purchased within the City <br />are required to meet the emission standards currently required (or as may be <br />amended from time to time) by the Environmental Protection Agency (EPA) and <br />Underwriters Laboratories (UL) listing. <br /> <br />All exterior solid fuel-fired heating devices are subject to regulation as public <br />nuisances as described in this Section. <br /> <br />Dense smoke, noxious fumes, gas and soot, or cinders, in unreasonable quantities, <br />are declared a public nuisance and are hereby made subject to regulation and <br />control by a properly designated authority. <br /> <br />Ail exterior solid fuel-fire heating devices installed within the City shall be listed <br />and labeled by a nationally recognized testing laboratory and installed according <br />to the manufacturer's recommendations. <br /> <br />The following materials shall not be used or burned in exterior solid fuel-fired <br />heating devices: grass leaves, oils, rubber, plastics, tires, railroad ties, <br />construction debris, and painted or chemically treated materials such as treated <br />lumber, composite shingles, tar paper, insulation composition board, sheetrock, <br />wiring, paint, and hazardous and industrial solid waste. <br /> <br /> Subd. 4. Violations. Any violation of this Subsection shall be considered a <br />misdemeanor and is subject to all penalties as provided by State Statute. <br /> <br />SECTION 3. SUMMARY <br /> <br />The following official summary of Ordinance #05-32 has been approved by the City Council of <br />the City of Ramsey as clearly informing the public of the intent and effect of the Ordinance. <br /> <br />It is the intent and effect of Ordinance #05-32 to amend Ramsey City Code Chapter 9 (Zoning <br />and Subdivision of Land) to: <br /> · Renumber existing Subsection 9.11.14 (Compliance) to 9.11.15. <br /> · Establish regulations and guidelines for exterior solid fuel-fired heating devices. <br /> <br />SECTION 4. EFFECTIVE DATE <br /> <br />The effective date of this Ordinance is thirty (30) days after its passage and publication, subject <br />to City Charter Section 5.06. <br /> <br />PASSED by the Ramsey City Council this the 13th day of December 2005. <br /> <br />Ordinance #05-32 <br />Page 2 of 3 <br /> <br /> <br />
