CC Regular Session 5. 11. <br />Meeting Date: 01/10/2023 <br />By: Chris Anderson, Community Development <br />Information <br />Title <br />Adopt Resolution #23-006 Approving the Final Plat and Development Agreement for Lywnood Second Addition <br />(Project No. 22-141); Case of U.S. Home, LLC dba Lennar <br />Purpose/Background: <br />The City has received an application from Lennar (the "Applicant") for approval of their Final Plat for Lynwood <br />Second Addition, which is located south and west of Fire Station #1 (the "Subject Property"). This phase of the <br />subdivision includes the remaining fifty-one (51) townhomes approved as part of the Preliminary Plat. The third <br />and final (future) phase will include the twelve (12) single family homes. <br />Notification: <br />Notification is not required for a Final Plat. <br />Observations/Alternatives: <br />The City Council previously approved a Zoning Amendment and Comprehensive Plan Amendment for the <br />project that rezoned the Subject Property from R-3 Residential (High Density) to R-2 Residential (Medium <br />Density) and from High Density Residential to Medium Density Residential, respectively. The Final Plat <br />conforms with the approved Preliminary Plat. <br />This phase will include an extension of 149th Lane and Ferret Street, both public roads, as well as the <br />construction of 150th Lane (public road), Gibbon Terrace (private road), and Gibbon Way (private road). <br />Additionally, it will include a watermain stub to serve Fire Station #1 (from the western or rear side of Fire <br />Station #1). Furthermore, with this second phase of the project, all of the required density transitioning plantings <br />along the northern and western boundaries of the Subject Property will be completed. <br />The proposed Development Agreement for Lynwood Second Addition is attached. <br />Alternatives <br />Alternative 1: Approve the Final Plat and Development Agreement for Lynwood Second Addition. The zoning <br />and land use designations were previously approved by the City Council, based on the Preliminary Plat. The Final <br />Plat conforms with the approved Preliminary Plat. Staff supports this alternative. <br />Alternative 2: Do not approve the Final Plat and Development Agreement for Lynwood Second Addition based <br />on certain findings. As noted, the Final Plat conforms with the approved Preliminary Plat. Staff does not support <br />this alternative. <br />Funding Source: <br />All costs associated with this application are the responsibility of the Applicant. <br />Recommendation: <br />Staff recommends approving the Final Plat and Development Agreement for Lynwood Second Addition. <br />Action: <br />
