CC Regular Session <br />Meeting Date: 01/10/2023 <br />By: Katie Schmidt, Administrative Services <br />Information <br />6.2. <br />Title: <br />PUBLIC HEARING - Review recommendation from the Charter Commission to amend the charter by Ordinance <br />#22-29 under M.S 410.12, subdivision 7 <br />Purpose/Background: <br />The Charter Commission met on October 26, 2022 and is recommending the City Council amend the charter by <br />Ordinance #22-29 under M.S. 410.12, subdivision 7. The recommended ordinance is to amend Section 2.4 of the <br />Charter that no member of the Council may serve on the Charter Commission or other Board or Commission. The <br />language in Ordinance #22-29 is the same language as the recently passed Ordinance #22-17 (attached for <br />reference). <br />The City Council received the recommendation from the Charter Commission on November 22, 2022. The City <br />published a notice of a public hearing of the proposal on Friday, December 16, 2022. Within one month of the <br />public hearing, the city council must vote on the proposed charter amendment ordinance. Under M.S. 410.12, <br />subdivision 7, if the City Council unanimously approves the ordinance then the ordinance is enacted 90 days after <br />passage and publication. Within 60 days of passage and publication, a petition requesting a referendum on the <br />ordinance may be filed with the City Clerk. <br />Notification: <br />N/A <br />Time Frame/Observations/Alternatives: <br />Next Steps: <br />• Per State Statute 410.12 Subd. 7., the Council must vote on the proposed charter amendment ordinance <br />within one month of the public hearing. <br />• Council introduces Ordinance #22-29 this evening, it will come back for final consideration on Tuesday, <br />January 24, 2023. <br />• If approved unanimously on January 24, 2023, the Charter amendment would then take effect 90 <br />days after publication. <br />• If Council does not unanimously approve Ordinance #22-29, then the ordinance would fail. <br />• If Ordinance #22-29 does not become enacted, then staff would proceed forward with the procedure <br />required for Ordinance #22-17. <br />Recommendation: <br />Staff recommends introduction of Ordinance #22-29, thus providing for an affirmative vote of final consideration <br />on January 24, 2023. This would satisfy requirements established in State Statute 410.12 Subd. 7. <br />Outcome/Action: <br />Motion to introduce Ordinance #22-29. <br />
