CASE <br /> <br />Background: <br /> <br /> ADOPT ORDINANCE TO VACATE EASEMENT <br /> IN RAMSEY TOWN CENTER 8TM ADDITION; <br /> CASE OF RAMSEY TOWN CENTER LLC <br />By: Sylvia Frolik, Assistant Community Development Director <br /> <br />There is an underlying drainage and utility easement from Town Center 8th Addition that impacts <br />Town Center 12th Addition. The easement to be vacated encumbered that area where a culvert <br />was installed under the trail in Bunker Lake Blvd. As a result of the implementation of the <br />grading plan for Ramsey Town Center 8th Addition, that easement is no longer required and the <br />culvert has been removed. On December 13, 2005, the City Council introduced an ordinance to <br />vacate the easement. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />Notification: <br /> <br />Site location map <br />Exhibit of underlying easement to be vacated <br />Proposed Ordinance <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the public heating on December 13, 2005, to vacate the easement. <br /> <br />Observations: <br /> <br />In accordance with the City Charter, the ordinance is now eligible for adoption. <br />Recommendation: <br /> <br />City Staff recommends adoption of the ordinance. <br /> <br />Council Action: <br /> <br />Motion to adopt Ordinance #06-01- to vacate the drainage and utility easement lying <br />within Outlot A, Ramsey Town Center 8th Addition, according to the recorded plat thereof, <br />Anoka County, Minnesota <br /> <br />Review Checklist: <br /> <br />Asst.
