I EC'D jI N 0 9 2006 <br /> <br />Record ID 1639560 <br /> <br />1980624.015 <br /> <br />Councilmember Pearson introduced the following resolution and moved for its adoption: <br /> RESOLUTION #05-09-336 <br /> <br />A RESOLUTION APPROVING TItE ISSUANCE OF A CONDITIONAL USE PERMIT <br />TO ALLOW THE CONSTRUCTION OF AN ACCESSORY STRUCTURE FOR A <br />LEGAL~ NON-CONFORMING RESIDENCE ON THE PROPERTY LOCATED AT 9537 <br />HIGHWAY #10 N.W., BASED ON FINDINGS OF FACT #0741 AND DECLARING <br />TERMS OF SAME. <br /> <br /> WItEREAS~ George and Frances Cowles (Permittee) have properly applied for a <br />Conditional Use Permit to construct an accessory structure for a legal, non-conforming residence <br />on the property generally known as 9537 Highway # 10 N.W. and legally described as follows: <br /> <br /> Lot 2, Block 1, Cowles Addition, Anoka County, Minnesota <br /> (Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on September 1, 2005, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact #0741, a Conditional Use Permit (Permit) is hereby granted to <br /> George and Frances Cowles, hereinafter referred to as the "Permittee" <br /> <br />2. That this permit shall allow the Permittee the right to construct a 768 square foot garage as an <br /> accessory use to the legal, non-conforming residence on the Subject Property. <br /> <br />3. That the construction of the detached accessory building on the Subject Property shall require <br /> issuance of a building permit from the City of Ramsey. <br /> <br />4. That the accessory building shall be properly constructed and maintained in accordance with <br /> all applicable Uniform Building Codes and local zoning regulations. <br /> <br />5. The Permittee herein agree that no business use will be operated in the detached accessory <br /> building unless such use is permitted in accordance with the City Code. <br /> <br /> 6. That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br />7. That the Permittee shall be responsible for all City costs incurred in administering and <br /> enforcing this Permit. <br /> <br /> <br />
