Commissioner Johnson stated he is willing to move this based on the 5,000 square foot building <br />only. <br /> <br />Motion by Commissioner Johnson to amend the Findings of Fact as follows: <br /> <br />1-5 as set forth. <br />6. That the Applicant is proposing to purchase the Subject Property and has submitted a site <br /> plan that proposes to utilize the existing 5,000 square foot accessory structure for a <br /> woodworking business. <br />7. Deleted. <br />8. Deleted. <br />9. Deleted. <br /> 10. That the proposed use will not substantially adversely impair... <br /> 11. That the proposed use will be designed, constructed, operated and maintained so as to be <br /> harmonious and appropriate... <br /> 12. That the proposed use will not be hazardous... <br /> 13. That the proposed use will not be disturbing... <br /> 14. That the proposed use will be a substantial improvement... <br /> 15. That the proposed use will be served adequately by essential public facilities... <br /> 16. That the proposed use will not create excessive additional requirements... <br /> 17. That the proposed use will not involve uses, activities and equipment that will be <br /> detrimental... <br /> <br />Further discussion: ~ct-mg Chairperson Nixt stated they are not at this point going to make any <br />indications for future expansion and the applicant would find it difficult to expand. He advised <br />the applicant not go into this with any expectation that he would be approved for another 5,000 <br />square feet. Commissioner Dempsey questioned why items 12, 14, and 16 are included. <br />Chairperson Nixt responded these items are included to address the City ordinance. <br />Commissioner Dempsey questioned how to reconcile substantial improvements to the property. <br />Commissioner Johnson stated these Conditional Use Permits are often designed for something <br />that is going to be constructed and they are being faced with a situation already in place. <br />Commissioner Kociscak stated he has a problem with this application. <br /> <br />Motion seconded by Commissioner Wivoda. <br /> <br />Motion failed. Voting yes: Commissioners Johnson and Wivoda. Voting No: <br />Chairperson Nixt, Commissioners Dempsey and Kociscak. Absent: Chairperson Anderson. <br /> <br />Motion by ~ Chairperson Nixt, seconded by Commissioner Kociscak, to recommend that <br />City Council adopt Findings of Fact relating to the request for a conditional use permit to operate <br />a woodworking business in a residential district with the following amendments: <br /> <br />1-6. <br /> <br />As previously set forth. <br />Consistent with the presentation. <br /> <br />Planning Commission/May 2, 2000 <br /> Page 6 of 23 <br /> <br /> <br />
