-236- <br /> <br />of competent jurisdiction, such decision shall not effect or void any of the other <br />provisions of this Contract. <br /> <br /> P. Proof of Authority. When the DEVELOPER is a corporation, the CITY <br />requires proof of authority by the corporation to execute this Contract. This proof of <br />authority may be satisfied by providing the CITY with a certified copy of minutes of the <br />corporate Board of Directors granting such authority. <br /> <br /> Q. Recording of This Contract. The DEVELOPER shall record this <br />Contract in the office of the Anoka County Recorder and agrees that the terms and <br />provisions of this Contract shall run with the land and shall bind the DEVELOPER, its <br />successor and assigns. <br /> <br /> R. Violation of This Contract. If the DEVELOPER fails to perform any of <br />the terms of this Contract in the manner required by the CITY, the CITY shall be <br />entitled to recover, from the DEVELOPER or the issuer of DEVELOPER'S financial <br />guarantee, the full amount of any and all financial guarantees. Breach of any of the terms <br />of this Development Contract by the DEVELOPER shall also be grounds for denial of <br />Building Permits for buildings in the Plat. <br /> <br /> S. Contract Binding On Successors and Assigns. The DEVELOPER agrees <br />that this Development Contract shall be binding upon its successors and assigns. <br /> <br />26. Requirements for Building and Occupancy Permits. No building permit for any lot in the <br /> Plat shall be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the <br /> structure; (b) a Certificate of Survey, including that survey information required by the <br /> CITY has been supplied to the CITY Building Official; and (c) all the financial guarantees <br /> required by the CITY have been satisfied. All foundation approvals will require a certificate <br /> of elevation verifying that the actual elevation is in compliance with the approved grading <br /> and drainage plan. (d) Permit from the Lower Rum River Watershed Management <br /> Organization has been obtained (e) Permit from Anoka County Soil Conservation District has <br /> been obtained (f) th/s Development Contract has been signed and received by the CITY. <br /> <br />No occupancy permit for any lot in the Plat shall be issued until: (a) vehicular access to the <br />lot is provided including the installation of at least one layer of bituminous surfacing; (b) all <br />utilities are in place, operational and accepted by the CITY; (c) for lots that have a slope of <br />less than 2%, a certificate of grading, prepared by a licensed (State of Minnesota), <br />professional land surveyor, must be provided to the CITY documenting that the flattest grade <br />on this lot is 1% or 'greater will require certificates of grading; and (d) boulevard sod and <br />landscape tree, or escrow for same, have been provided. <br /> <br />27. Parkland and Trail Dedication. The Subject Property is located in the Greenland Hills <br /> District. In accordance with the Park and Trail Dedication Contract dated April 12, 2005, <br /> there is a park payment obligation due to the CITY in amount of Fifty Four Thousand <br /> Dollars and no cents ($54,000.00) (72 units x $750/unit). It is noted that the CITY has <br /> already received $6.4 million from RAMSEY TOWN CENTER, LLC in land and cash for <br /> <br />Ramsey Town Center 12th Addition <br />Development Contract <br /> Page 11 of 13 Pages <br /> <br /> <br />
