Case #13: <br /> <br />Adopt an Ordinance Amending Section 9.11 (Performance Standards) of <br />City Code; Case of City of Ramsey <br /> <br />Assistant Community Development Director/HRA Executive Director Frolik reviewed that <br />earlier this year, the City received a building permit application for an exterior solid fuel-fired <br />heating device. During the review process of this application, staff realized that there are no <br />standards or regulations for these appliances in City Code. Due to their potential to create <br />nuisance for neighboring properties, staff has drafted an ordinance to establish some basic <br />regulations for these devices. Ms. Frolik stated the City Council introduced the ordinance on <br />October 25, 2005. During that meeting, the Fire Chief raised some concerns with the proposed <br />ordinance. Staff has conferred with the Fire Chief and after reviewing the draft ordinance, the <br />Fire Chief is satisfied that his concerns are addressed in the proposed ordinance. In accordance <br />with the City Charter, the ordinance is now eligible for adoption. <br /> <br />Public Works Director Kapler stated the ordinance addresses his concerns. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Strommen, to adopt Ordinance <br />#05-32 amending City Code Section 9.11 (Performance Standards) to establish regulations for <br />exterior solid fuel-fired heating devices. <br /> <br />Further discussion: Councilmember Elvig asked if this ordinance also addresses coal burning <br />stoves. He noted coal buming leaves a residue on neighboring houses. Public Works Director <br />Kapler replied the ordinance only suggests fuels that are not acceptable. The ordinance includes <br />safeguards against bumers providing excessive amounts of smoke. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Mayor Gamec: aye <br />Councilmember Cook: aye <br />Councilmember Elvig: aye <br />Councilmember Jeffrey: aye <br />Councilmember Olson: absent <br />Councilmember Pearson: aye <br />Councilmember Strommen: aye <br /> <br />Motion carried. <br /> <br />Case #14: <br /> <br />Consider Amending Resolution Authorizing Acquisition of Right-of-Way for <br />the Improvement of Potassium Street NW <br /> <br />City Attorney Goodrich reviewed that in June of this year the Council authorized acquisition of <br />right-of-way by eminent domain if necessary for improvement of Potassium Street NW. He <br />explained the necessary right-of-way width for Potassium Street has been determined. In order <br />to accomplish the Council's directive of having the actual pavement as far west as possible on <br />the residents' side of the property, the pavement has also been narrowed from 32 feet to 24 feet. <br />Mr. Goodrich reviewed the right-of-way necessary on Parcels 1 through 6.
