Motion by Councilmember Jeffrey, seconded by Councilmember Cook, to introduce an <br />ordinance to vacate the drainage and utility easements contained on Outlot 1, Ramsey Town <br />Center Addition. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Jeffrey, Cook, Elvig, Pearson, <br />and Strommen. Voting No: None. Absent: Councilmember Olson. <br /> <br />Case #4: Request for an Interim Use Permit; Case of Robert Guzzo <br /> <br />Mayor Gamec indicated that Mr. Guzzo was not able to attend this meeting tonight. <br /> <br />Assistant Community Developmem Director/HRA Executive Director Frolik indicated staff was <br />informed by Mr. Guzzo today that he has found a commercial site to lease. The building will not <br />be available until February 1, 2006, and he would like six to eight weeks to move in. Mr. Guzzo <br />is requesting that the Council accept the recommendation of the Planning Commission and allow <br />him until March 21, 2006 to relocate. The City Attorney recommends that the Council adopt the <br />negative findings and motion to deny the interim use permit and set a date for Mr. Guzzo to <br />vacate and relocate to an appropriately zoned property. <br /> <br />Mayor Gamec suggested the agreement allow Mr. Guzzo six months to relocate, as he does not <br />believe March 31st will allow him enough time to relocate. <br /> <br />City Attorney Goodrich advised a permit should be issued for a six month time period. <br /> <br />Councilmember Elvig indicated he agrees with the longer time period for relocation. He <br />expressed concern with violations that may currently be occurring on the site, such as with <br />traffic. <br /> <br />City Attorney Goodrich advised the Police Department should be able to enforce the traffic <br />issues on the site. <br /> <br />Councilmember Strommen commented Mr. Guzzo has indicated March 31st allows him enough <br />time to relocate. <br /> <br />Councilmember Elvig suggested an agreement be drafted with Mr. Guzzo stating that the <br />conditions of the interim use permit will still be enforced until he vacates the property. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Strommen, to adopt Resolution <br />#05-12-419 adopting Findings of Fact #0749 supporting denial of Robert Guzzo's request for an <br />Interim Use Permit. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Cook, Strommen, Elvig, Jeffrey, <br />and Pearson. Voting No: None. Absent: Councilmember Olson. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Cook, to adopt Resolution #05- <br />12-420 to deny Robert Guzzo's request for an interim use permit and specify that the business <br /> <br />City Council / December 13, 2005 <br /> Page 9 of 37 <br /> <br /> <br />
