Mr. Christensen inquired if a new property owner would have to receive approval from the City <br />before conducting the same business in the home if the property were to be sold. <br /> <br />Chairperson Nixt explained that if the property were sold and the new owners conducted a <br />massage business under the same terms, then they would not need permission from the City. If <br />the terms were to change, then they would have to get approval from the City. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Kociscak, to close the public <br />hearing. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Kociscak, and Reeve. <br />Voting No: None. Absent: Commissioners Griffiths and Wivoda. <br /> <br />The public hearing closed at 7:20 p.m. <br /> <br />Commission Business <br /> <br />Chairperson Nixt called the regular meeting of the Planning Commission back to order at 7:20 <br />p.m. <br /> <br />Commissioner Reeve inquired if it would be possible to review the compliance of the conditional <br />use permit in 6 months or a year. <br /> <br />Community Development Director Frolik replied that the Planning Commission could request a <br />one-year review to determine compliance. <br /> <br />Commissioner Kociscak inquired as to what the procedure would be if a complaint was received <br />about the business. <br /> <br />Community Development Director Frolik reviewed the procedure. <br /> <br />Consensus of the Commission was that the normal complaint review process would be adequate. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Kociscak, to recommend that <br />City Council adopt Findings of Fact in the positive relating to Cathleen Artman's request for a <br />conditional use permit. <br /> <br />Motion Carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Kociscak, and Reeve. <br />Voting No: None. Absent: Commissioners Griffiths and Wivoda. <br /> <br />Motion by Commissioner Johnson, seconded by Commissioner Kociscak, to recommend that <br />City Council approve Cathleen Artman's request for a conditional use permit for a home <br />occupation based on the findings of fact. <br /> <br />Planning Commission/November 6, 2000 <br /> Page 6 of 21 <br /> <br /> <br />
