Board Member Kociscak noted that the vote for the last motion under Case #1 should be chm~ged
to include Board Member Nixt as voting yes and Chairperson Anderson as absent.

Motion by Board Member Kociscak, seconded by Board Member Nixt, to approve the following
minutes as amended:

1) Board of Adjustment public hearing regular meeting minutes dated May 2, 2000

Motion carried. Voting Yes: Chairperson Anderson, Board Members Kociscak, Nixt, Dempsey,
and Johnson. Voting No: None. Absent: Board Member Wivoda.

INTRODUCTION OF NEW BOARD MEMBER

City Attorney Goodrich swore in the new Board Member Michael Reeve.

PUBLIC HEARINGS/BOARD BUSINESS

Case #1:

Request for a Variance to Accessory Structure Setback Requirements; Case
of Michael and Anita Kucala

Chairperson Anderson closed the regular portion of the Board of Adjustment meeting at 7:08
p.m. in order to conduct the public hearing.

Public Hearing

Chairperson Anderson called the public hearing to order at 7:08 p.m.

Presentation

Community Development Director Frolik stated that City Code states that accessory structures
shall not be constructed nearer the front property line than the principal structure. Michael and
Anita Kucala requested a variance to construct a garage nearer the front property line than the
principal structure at 15541 Zirconium Street NW, Ramsey. The parcel is approximately 4.5
acres in size, and the house is located approximately 234 feet from the nearest point of the
property line. Mr. Kucala is proposing to construct a garage which will be approximately 210
feet from the nearest point of the property line. The site plan submitted and an on-site inspection
reveal that the property is significantly covered by mature tree growth, and some wetlands and
declining topography. These features prohibit construction of a garage in the side or rear yard. It
is staff's opinion that the mature tree growth in the area and the alignment of neighboring homes
along the street are such that there should be no adverse impact to the neighbors view of the
street scape by the construction of the proposed garage.

Board of Adjustment/July 10, 2000
