Voting No: None. <br /> <br />PUBLIC HEARINGS/BOARD BUSINESS <br /> <br />Case #1: <br /> <br />Request for a Variance to Minimum Lot Size in the Rural Service Area; <br />Case of David and Grace Ibach - · <br /> <br />Vice-Chairperson Kociscak closed the regular portion of the Board of Adjustment meeting at <br />7:03 p.m. in order to conduct the public hearing. <br /> <br />Public Hearing <br /> <br />Vice-Chairperson Kociscak called the public hearing to order at 7:03 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated that David and Grace Ibach reside at 7630 181st <br />Avenue NW. The adjacent parcel to the north has a driveway that has been partially located on <br />the Ibach parcel for approximately 30 years. The Ibach's are interested in correcting the problem <br />and conveying part of their property to the new owner of the property to the north, Brian <br />Vanderlee. The Ibach's would like to convey a portion of their property to Mr. Vanderlee via an <br />Administrative Subdivision. An Administrative Subdivision, which is approved at the City staff <br />level, is a conveyance of property between adjacent property owners by metes and bounds <br />description rather than by platting. However, City staff cannot approve an Administrative <br />Subdivision that will render one of the lots substandard. Mr. Ibach's property is located in the <br />Rural Service Area and the minimum lot size is 10 acres. Mr. Ibach's property is 10 acres in <br />size. In order to correct the erroneous driveway problem, Mr. Ibach would like to convey 1.4 <br />acres of his property to Mr. Vanderlee. This will result in a new lot size of 8.6 acres on Mr. <br />Ibach's property. Therefore, the administrative subdivision cannot be processed unless a <br />variance to minimum lot size is granted. If granted, the variance will not create any new lots and <br />compliance with the density restriction of 4 lots in 40 acres will be maintained. The City has on <br />at least one other occasion, granted a variance to the minimum lot size in the Rural Service Area. <br /> <br />Citizen Input <br /> <br />David Ibach, 7630 181st Avenue NW, Ramsey, explained that a portion of Mr. Vanderlee's <br />driveway crosses the corner of his lot and in order to correct the situation he would prefer to sell <br />the 1.4 acres to Mr. Vanderlee. <br /> <br />Board Member Dempsey inquired if the driveway services the Vanderlee property only. <br /> <br />Mr. Ibach replied yes. <br /> <br />Board of Adjustment/October 3, 2000 <br /> Page 2 of 5 <br /> <br /> <br />
