Councilmember Elvig introduced the following resolution and moved for its adoption: RESOLUTION #05-11-381 RESOLUTION APPROVING 2ND FINAL PAYMENT TO BAUERLY BROS. INC FOR 2005 PAVEMENT MAINTENANCE PROGRAM - DIVISION B WHEREAS, on May 10, 2005, the Ramsey City Council authorized plans and specifications and advertisement for bids on 2005 Street Maintenance Program - Division B, and WHEREAS, on June 14, 2005, the Ramsey City Council adopted Resolution #05-06-174 awarding the bid for 2005 Pavement Maintenance Program - Division B to Bauefly Brothers in the amount of $281,001.65, and WHEREAS, City Engineer, Steve Jankowski has inspected the completed work and recommends 2nd final payment to Bauerly Brothers, Inc. in the amount of $60,318.05. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: 1) That the City Council hereby authorizes partial payment to Bauerly Brothers, Inc. for Improvement Project 2005 Street Maintenance Program - Division B in the amount of $60,318.05. 2) That the City Council hereby accepts the project and authorizes the Mayor or City Administrator to sign the release form for this payment. 3) That the total amount of this payment is not included in resolutions approving payment of bills for the date of November 22, 2005. 4) That the City of Ramsey Finance Department will be provided a signed copy of this resolution. The motion for the adoption of the foregoing resolution was duly seconded by Councilmember Pearson, and upon vote being taken thereon, the following voted in favor thereof: Mayor Gamec Councilmember Elvig Councilmember Pearson Councilmember Cook Councilmember Jeffrey Councilmember Olson Councilmember Strommen and the following voted against the same: RESOLUTION #05-11-381 Page 1 of 2
