Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-12-397 <br /> <br />RESOLUTION APPROVING 2ND PARTIAL PAYMENT TO KOBER EXCAVATING <br />INC. FOR PROJECT #02-40 OAK TERRACE ESTATES MOBILE HOME PARK, <br />SANITARY SEWER, WATERMAIN AND STORM SEWER IMPROVEMENTS <br /> <br /> WHEREAS, on August 9th, 2005 the Ramsey City Council adopted Resolution #05-08- <br />259 approving plans and specifications and ordering advertisement for bids for Oak Terrace <br />Estates Sanitary Sewer and Watermain; and <br /> <br /> WHEREAS, on September 27th, 2005, the Ramsey City Council adopted Resolution <br />#05-09-340 awarding the contract for IP #02-40 to Kober Excavating Inc. in the amount of <br />$447,486.05; and <br /> <br /> WHEREAS, Assistant Public Works Director/Principal Engineer, Brian Olson has <br />inspected the completed work and recommends 1st partial payment to Kober Excavating Inc. in <br />the amount of $106,380.98. <br /> <br /> WHEREAS, Assistant Public Works Director/Principal Engineer, Brian Olson has <br />inspected the completed work and recommends 2nd partial payment to Kober Excavating Inc. in <br />the amount of $218,128.05. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1) <br /> <br />That the City Council hereby authorizes partial payment to Kober Excavating Inc. for <br />Improvement Project #02-40 in the amount o f $218,128.05. <br /> <br />2) <br /> <br />That the City Council hereby accepts the project and authorizes the Mayor or City <br />Administrator to sign the release form for this payment. <br /> <br />3) <br /> <br />That the total amount of this payment is not included in resolutions approving payment of <br />bills for the date of December 13, 2005. <br /> <br />4) <br /> <br />That the City of Ramsey Finance Department will be provided a signed copy of this <br />resolution. <br /> <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Jeffrey, and upon vote being taken thereon, the following voted in favor thereof: <br /> <br />Mayor Gamec <br />Councilmember Elvig <br />Councilmember Jeffrey <br />Councilmember Cook <br />Councilmember Pearson <br /> <br />RESOLUTION #05-12-397 <br /> Page 1 of 2 <br /> <br /> <br />
