Councilmember Cook introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #05-12-421 <br /> <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0750 RELATING TO A <br />REQUEST FROM LUMAX LLC TO ALLOW THE OUTDOOR DISPLAY VEHICLES <br />FOR SALE AT 6246 HIGHWAY 10 NW. <br /> <br /> WHEREAS, Lumax LLC, hereinafter referred to as the "Applicant," has properly <br />applied for a Conditional Use Permit to display vehicles for sale on the property generally known <br />as 6246 Highway 10 NW and legally described as follows: <br /> <br />Lot 10, AUD. SUB. NUMBER 96 <br />("Subject Property") <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating <br />to the request are determined to be as follows: <br /> <br />That the Applicants failed to appear before the Planning Commission for a public hearing <br />pursuant to Section 9.03.04 of the Ramsey City Code on November 3, 2005, and that said <br />public hearing was properly advertised and that the minutes of said public hearing are hereby <br />incorporated by reference. <br /> <br />That the City Council met on November 22, 2005 to review the request for a Conditional Use <br />Permit to allow the outdoor display of vehicles for sale, and, after discussion, found it most <br />appropriate to grant an interim use permit for a period of years, to be determined by City <br />Staff. <br /> <br />3. That the Subject Property is zoned E-1 Employment <br /> <br />4. That the Subject Property is approximately .44 acres in size. <br /> <br />5. That City Code restricts retail sales and outdoor display areas as a principal use, and requires <br /> a conditional use permit within the E-1 District. <br /> <br />6. That the Applicant would like to establish a motor vehicle sales lot with outdoor display of <br /> merchandise on the Subject Property. <br /> <br />7. That the surrounding properties are a mixture of manufacturing and retail, auto-related uses. <br /> <br />8. That the proposed use will not be unduly dangerous or otherwise detrimental to persons <br /> residing or working in the vicinity of the use or to the public welfare. <br /> <br />9. That the proposed use will not substantially adversely impair the use, enjoyment, or market <br /> value of surrounding property. <br /> <br />10. That the proposed use will not be hazardous or disturbing to existing neighboring uses. <br /> <br /> <br />
