Community Development Director Tmdgeon clarified there were questions about the use of the <br />road over the summer. The issue could not get on the Public Works agenda until this time, and <br />this may not be an issue any longer. <br /> <br />The consensus of Mr. and Mrs. Kaas, Mr. Dusbabek and Mr. Bower was that they are not in <br />agreement with 160th Lane being turned into a full City road. <br /> <br />There was considerable discussion with the residents and the Public Works Committee regarding <br />the current use of 160th Lane and the possibility of improving the road to the status of a public <br />street. <br /> <br />City Attorney Goodrich advised on the necessity of emergency vehicle access on the road. <br /> <br />Public Works Director Kapler indicated he has viewed the site and the driveway is more than <br />adequate for emergency vehicle access. <br /> <br />Councilmember Cook suggested a gravel City road be put in and maintained by the City until the <br />road needs to be upgraded to accommodate more traffic. He stated the issues will never be <br />solved by leaving the road in the current configuration. <br /> <br />Chairperson Elvig stated the full Council has deliberated on this and it is now a legal access. <br />The City has legal right to improve this to a full road. The question is whether the Public Works <br />Committee wants to recommend a full road to stop potential neighborhood disputes. In his <br />opinion, he does not know that the City should throw money into stopping neighborhood <br />disputes. He indicated he will be abstaining from any votes on this issue. <br /> <br />Assistant Public Works Director Olson advised a full road would benefit other residents that use <br />that section of road as well. <br /> <br />Motion by Councilmember Cook to upgrade 160th Lane to a full width class 5 non-bituminous <br />road to be maintained and cared for by the City. <br /> <br />The motion died for lack of second. <br /> <br />Chairperson Elvig suggested this issue be forwarded to the full Council for discussion. <br /> <br />City Attorney Goodrich recommended a work session agenda item be scheduled for this <br />discussion. <br /> <br />Chairperson Elvig suggested the homeowners get together and determine if they can come up <br />with a resolution on this issue, and that they attend the Council work session to discuss the <br />agreed upon resolution. <br /> <br />Mr. Bower requested direction regarding maintenance of the pathway, as he was informed to <br />desist doing anything with the maintenance at this time. <br /> <br /> Public Works Committee / September 20, 2005 <br /> Page 7 of 9 <br /> <br /> <br />
