CASE # 1 <br />PARK DEDICATION FOR SHADE TREE COTTAGES <br /> By: Leonard Linton, Civil Engineer <br /> <br />Background: <br /> <br />Shade Tree Communities, LLC has submitted the preliminary plat for Shade Tree Creek. This <br />is a proposed cluster development located south of 177m Avenue and Erkium Street. The <br />cluster ordinance allows for development in areas not currently served by sewer by requiring <br />urban size lots, common water and sewer systems for the development. The number of lots <br />that can be developed at this time is based on the requirement of 2.5 acres per unit which is 16 <br />lots. The remainder of the parcel will be platted as outlots, further development will not occur <br />until city sewer and water is extended to the site. <br /> <br />This plat adjoins Riverbrook Addition which was platted several years ago. The southwest <br />comer is common with the northeast corner of a conservation easement anticipated to be <br />acquired by the City along the north side of Trott Brook. The development is in the Rogers <br />Lake Recreation District. The Rum River Central County Park is on the east side of the <br />District. <br /> <br />Observation: <br /> <br />The area being platted as lots and right of way is 9.53 acres. The density is less than 3 units <br />per acre so the land dedication required is 10% or 0.95 acres. Staff is recommending land <br />dedication for a trail corridor. The land to be dedicated is a strip 75 feet wide by 700 feet long <br />and runs from the southwest corner, north along the west property line as shown on the <br />attached exhibit. Staff has done a preliminary design and this strip will provide space for <br />construction of a trail to connect to the Conservation and trail easement being acquired. This <br />strip coincides with Lot 1, Block 3 on the future plat. This area is 1.20 acres, resulting in a <br />dedication credit of 0.25 acres that can be credited to the future park dedication requirements. <br /> <br />The developer mus~ provide area for a 10 foot trail along the proposed streets. The City <br />requires a minimum 6 foot wide boulevard between the back of curb and the trail. The space <br />for the trail can be provided in one of two ways, either by dedicating a 66 foot right of way <br />along the future streets (177~ Avenue and the portion of Erkium north of 177~ Avenue); or <br />providing a 3 foot trail easement along this route. The trail will connect in the future to Rum <br />River Central Park as well as the Trott Brook Trail. <br /> <br />Staff Recommendation: <br /> <br />Staff recommends park dedication for Shade Tree Creek in the form of land. The area to be <br />dedicated is a strip along the west boundary of the site, 75 feet in the east west direction and <br />700 feet in the north south direction. This land area exceeds the requirement so the excess, <br />0.25 acres will be credited towards future park dedication requirements. Trail fees will be <br />made in cash in the amount of $9,280 (16 lots @ $580.00). <br /> <br /> <br />
