Robert Dillon, 6255 Highway #10 NW, Ramsey, stated he has two properties comprising of ten <br />acres, which is the mass of this district. He asserted that the corn field is still an open field. <br /> <br />Councilmember Hendriksen stated Plants and Things is a nonconforming, commercial use and is <br />expanding without the proper City approvals. <br /> <br />Mr. Dillon stated none of them want any part of this district. He stated he does not have a need <br />for this project and does not believe it can be forced upon him. He stated he would not object to <br />taking care of drainage for Zitzloff's property and suggested the City look at taking the water <br />across to the existing pond or have Zitzloff create his own pond. He stated he is a 40-year <br />resident and asked why this should be forced upon him. <br /> <br />Councilmember Hendriksen stated Plants and Things is expanding their nonconforming use in <br />ways that are contrary to City ordinance. He stated he is sympathetic with Plants and Things but <br />when expanding a nonconforming use, it must be done in conformance with the City's ordinance. <br />He noted the display area has been expanded so they are choosing to expand the use and not <br />provide for the drainage. <br /> <br />Mr. Dillon stated they have not added Class 5 or blacktop, it is all hard packed sand and can be <br />driven on. <br /> <br />Councilmember Hendriksen suggested there is more runoff from a packed roadway which <br />creates additional drainage. <br /> <br />Mayor Gamec noted with the amount of blacktop and building, a problem exists with drainage <br />that must be solved. He stated the City is being asked if it will force them to sell or move and <br />that may be the case but improvements are needed. He stated the City cannot continue to <br />develop as Burger King was allowed to do with on site ponds. <br /> <br />Mr. Dillon stated this water is not his problem or the problem of any of the other land owners. It <br />belongs to Zitzloff or whoever sold him the property. <br /> <br />Councilmember Hendriksen stated all properties contribute to drainage and he anticipated the <br />eastern half could be done since that is the area of immediate need and the western half will be <br />done at a later date. However, it is just as cheap to do both. He stated the City's ordinances <br />require blacktop when doing what is being done at Plants and Things, which would necessitate <br />the need for drainage. <br /> <br />Mr. Dillon stated he cannot farm the ground with blacktop but can move the pots from Plants and <br />Things. He stated it was farmed last year and this year he plans to farm at least part of it. Mr. <br />Dillon stated he cannot afford the storm sewer cost. <br /> <br />Mayor Gamec stated the Council has heard the objection of Mr. Dillon that he does not want it <br />and believes it is unfair. <br /> <br />City Council/April 11, 2000 <br /> Page 7 of 27 <br /> <br /> <br />
