City Administrator Norman stated there should not be much in the way of fees unless a session is <br />attended. He stated he will work out the details and bring back this matter in January of 2006. <br /> <br />2) Highway I0 Property Acquisition <br /> <br />City Administrator Norman stated the Council has discussed potential Highway 10 property <br />acquisition and the Anchor's Away building that operates an oil change business with storage <br />behind the building. He explained that the City is waiting for bonding on the Anchor's Away <br />building. In addition, the City has been approached several times by the Sunfish Express gas <br />station on Sunfish Boulevard and Highway 10. That business did receive a positive <br />recommendation from the Planning Commission for an oil changing business but the owner did <br />not proceed with that request. <br /> <br />City Administrator Norman advised that the Council has not recently discussed the issue of City <br />bonding. He noted that mixed messages were received from the Metropolitan Council regarding <br />what is eligible and clarification has been received that RALF funds will reach the end of their <br />list so they will need to start limiting projects until the next round of funding is received. <br /> <br />Councilmember Strommen arrived at 5:47 p.m. <br /> <br />City Administrator Norman asked if the Council has concerns or if staff should proceed. <br /> <br />Finance Director Lund advised that at the next meeting, the Council will consider the <br />redevelopment plan and then the bonding will be considered. <br /> <br />Councilmember Cook asked if both businesses are interested in leasing back. <br /> <br />City Administrator Norman advised that Jim Deal's son is running the Express Lube business <br />until the legal exchange takes place. He had wanted to sell it to a partnership from the former <br />RTC but the City said no because it was so complicated. Then they found one employee of <br />Express Lube who said rather than going out of business, he would like to buy the business and <br />lease the space from the City. City Administrator Norman advised that Denny Sharp said he <br />would take the storage area of both businesses. He explained that Mr. Sharp is interested in <br />obtaining more storage so that would work out well. City Administrator Norman reported that <br />staff met with Mr. Sharp to work out the details and determine what the market lease would be <br />for that space. However, the City will need to assure that the bond payments can be met. <br /> <br />Councilmember Cook asked what will happen once the property is needed for the freeway and if <br />relocation costs will have to be paid if it is leased space. <br /> <br />City Administrator Norman explained that the City cannot write a lease saying it will not pay <br />relocation costs so leasing the space would not make paying relocation fees go away. However, <br />if the business were to fail and go out of business, then relocation fees would not be paid. <br /> <br />Mayor Gamec stated if the business is purchased, then the seller would be a willing seller.
