REG9 FEB 0 1 OOfi Record ID 1646099 485950.007 Chairperson Nixt introduced the following resolution and moved for its adoption: RESOLUTION #05-12-395 A RESOLUTION APPROVING THE ISSUANCE OF A VARIANCE AND DECLARING TERMS OF SAME. WHEREAS, RAMSEY TOWN CENTER, LLC, hereinafter referred to as "Applicant," has properly applied for a variance from Section 9.20.25(3)(b) regarding maximum front yard setbacks and driveway lengths in the TC-4a Sub-District of the Town Center District, on the property legally described as follows: Outlot A, Ramsey Town Center 8th Addition, according to the recorded plat thereof, Anoka County, Minnesota or upon recording: Lots 1-12, Block 1, Ramsey Town Center 12th Addition, according to the recorded plat thereof, Anoka County, Minnesota (the "Subject Property) WHEREAS, the Board of Adjustment met on December 1, 2005, conducted the public hearing and adopted findings of fact relating to the request for a variance from the maximum front yard setback and driveway length requirements as part of the development of the Subject Property. NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows Based on Resolution #05-12-394 adopting Findings of Fact #0748, a variance to the maximum front yard setback and driveway length, as established in Section 9.20.25(3)(b) of the Ramsey City Code, is approved for the development of townhomes on the Subject Property. That the development of the Subject Property is herein approved with a maximum front yard setback of thirty-five (35) feet and a maximum driveway length of seventy (70) feet. That the placement of the townhome structures shall generally be in accordance with the Variance Exhibit dated November 22, 2005. The Permittee shall be responsible for all City costs incurred in processing the variance request.
