program for individual sewage treatment systems (ISTS) in accordance with Minnesota Rule
7080. Specifically, it is being requested that the City update the sewage disposal ordinance to
require monitoring of all ISTS every three years and notifying homeowners of the requirement.
Mr. Goodrich and the Community Development Director studied the Minnesota Rule 7080 and it
appears that there are two issues the City is dealing with: maintenance assessment and
compliance inspections. Compliance Inspections are required for new construction, replacement
or repairs of ISTS and at point of sale of property containing an ISTS. These compliance
inspections must be performed by a certified inspector. The City currently has this requirement
in City Code and is administering it accordingly. Rule 7080 also requires that ISTS have a
maintenance assessment every three years and these can be performed by the homeowner.
Consequently, staff has drafted an ordinance amendment that will establish that maintenance
assessments of ISTS are required at least every three years and an annual reminder of this
requirement will be published in the City newsletter. In addition, the City currently requires
pumpers to submit a list of addresses where the ISTS have been pumped and that information is
maintained in the computer and the property files. The proposed ordinance would affirm the
pumping records procedure.

Councilmember Hendriksen inquired if it is a requirement of 7080 for pumper's to submit
information to the City.

City Attorney Goodrich replied no.

Councilmember Anderson questioned how the homeowner would complete the assessment.

Councilmember Hendriksen replied that the homeowner would be able to do the assessment
themselves or hire someone to complete the assessment.

City Attorney Goodrich noted that a homeowner can assess the system, but would need a
licensed individual to do any pumping or repairs on the system.

Councilmember Hendriksen inquired if the City Attomey and staff have confidence that they can
write a letter to the Met Council that the City has amended their ordinance to make it fully
comply with State Statue 7080.

City Attorney Goodrich replied yes, explained that he has reviewed the statute thoroughly and is
confident the City is complying with 7080.

Councilmember Hendriksen stated that staff should advise the Met Council the date the
ordinance will be adopted and the 60-day clock should begin at that time and also include in the
letter the language regarding the 60-day period. Mr. Hendriksen also requested that the Council
take one last look at the Comprehensive Plan because the Council may want to reconsider some
of the property designated for high density development.

City Council/June 13, 2000
