Mr. Hanson stated that the Azurite Business Communication Association and himself continue to <br />be in disagreement with the City of Ramsey regarding whether both Phase I and Phase II portions <br />of this project requires a conditional use permit. In ordinance 9.14.02 Scope it states that: "In <br />addition to the criteria outlined in Chapter 9.03.04 of the Ramsey City Code pertaining to <br />conditional use permits, these are rules and standards that regulate the issuance of conditional use <br />permits for storage, collection, transpiration, treatment, utilization, processing, transfer, <br />intermediate disposal and final disposal of solid waste or processed waste product by any person <br />and the issuing of conditional use permits for the construction and operation of solid waste <br />facilities." He expressed that it is clear that the ordinance pertains to the transportation of solid <br />waste and, therefore, to facilities for parking, maintenance and housing of the route trucks and <br />semi-trailers. The City Engineer indicted during the May 23rd meeting that the City should swap <br />Outlot A for the tiny portion of the site where Azurite curves onto the property and in Mr. <br />Hanson's opinion this would not be even close to an equivalent exchange as required by City <br />Code. Further, the City Engineer noted that Azurite and McKinley streets have not been <br />formally platted, meaning that the site description is not complete and by City Code permits, site <br />approvals can only be granted for full defined properties. Ramsey City Code 9.14.05 requires the <br />exact legal property description and acreage of the site. Mr. Hanson also pointed out that Ace <br />Solid Waste Management's purchase agreement is contingent on getting approval of Phase II <br />development, therefore, it was improper to give Ace Phase I approval separately. And lastly, he <br />stated that the Association has information from a source at Waste Management, Inc. that a letter <br />of intent has been signed to purchase Ace Solid Waste and if this is so it would mean that Ace is <br />no longer the applicant in the matter. <br /> <br />Mayor Gamec replied that his concerns will be reviewed by the City Attomey. <br /> <br />Mayor Gamec introduced the new City Engineer Brian Olson to the City Council. <br /> <br />City Engineer Olson gave a brief history of his engineering background. <br /> <br />Roger Hanson, Bake Star, questioned if Consent Agenda item #8 pertained to their property. <br /> <br />City Engineer Jankowski replied no, explaining that it referred to the Maken property. <br /> <br />APPROVE AGENDA <br /> <br />City Attorney Goodrich requested that Case #15a: "Introduce Ordinance to Establish <br />Maintenance Requirements for Individual Sewage Disposal Systems," and Case #15b: <br />"Proposed Ordinance to Establish Density Standards in the R-1 Urban Residential District" be <br />added to the agenda. <br /> <br />City Administrator Norman requested that Mayor Council Input include Item #2: T.H. #47 <br />detour signage, Item #3: Scheduling Park Commission Tour, and Item #4: Schedule work <br />session after the Public Works Committee. <br /> <br />City Council/June 13, 2000 <br /> Page 5 of 26 <br /> <br /> <br />
