Mayor Gamec stated that the main issue for discussion should be the Charter Amendment <br />question as recommended by the Charter Commission, but the additional advisory question <br />should be explained. <br /> <br />Councilmember Anderson stated that the Charter Commission specifically wanted the single <br />question sent to the voters and they did not want the advisory question sent to the voters and for <br />that reason she felt the issues should be kept separate. <br /> <br />Charter Commissioner Childs replied that the Charter Commission would be willing to discuss <br />the advisory question. <br /> <br />Mayor Gamec requested that the City Attorney work with the Charter Commission. <br /> <br />City Attorney Goodrich noted that Councilmembers could attend the Q & A meeting and express <br />their opinions on the issues. <br /> <br />Consensus of the Council was to have the staff from Cable TV produce an informational <br />program explaining the issues of both the proposed Charter Amendment question and the <br />advisory question. <br /> <br />Case #2: <br /> <br />Request to Rezone Certain Property from R-1 Rural Residential to R-1 <br />Urban Residential; Case of Reilley Estates Partnership, Ini:. <br /> <br />City Administrator Norman stated that Reilley Estates Partnership is requesting a rezoning of <br />property proposed to be platted into single-family, urban, residential lots. The property is <br />approximately 75 acres in size. The Comprehensive Plan amendment initiated by Ramsey in <br />1993, and approved by the Metro Council in 1995, placed the subject property in the <br />Metropolitan Urban Service Area (MUSA) for residential development with urban services. The <br />adjacent parcels to the north, east and west and on the south side of 153rd Avenue NW are also in <br />the MUSA and zoned rural residential. The surrounding properties were developed prior to <br />being included in the MUSA and consist of the larger, rural lots ranging in size from 1 to 2.5 <br />acres and are served by on-site well and septic. The current Comprehensive Plan targets this area <br />for residential development with urban services. In accordance with City Code, a general <br />development plan accompanied the application for rezoning. Although the general development <br />plan is not in compliance with our current performance standards, it does reflect the intent to <br />develop the property with single family urban lots. Approval of the rezoning would be based on <br />the Comprehensive Plan and the applicant's intent to develop the property with single family <br />residential lots. The platting process will review the proposal with respect to lot sizes, density, <br />tree preservation, street layouts, grading and drainage plans, sewer/water/storm sewer plans, etc. <br />The request was presented to the City Council on July 25, 2000. Councilmember Anderson was <br />not present and, at her request, the case was tabled until August 8, 2000, in order that she might <br />participate in the discussion and action. On August 8, 2000, the City Council discussed the fact <br />that this development proposal was the subject of a recent lawsuit which has been appealed by <br /> <br />City Council/September 13, 2000 <br /> Page 7 of 19 <br /> <br /> <br />
