<br /> is hereby give~ that the Ramsay City Cou6cil
<br /> will meet at ?:00 p.m., Tuesday, September 26,
<br /> 2006, to pass ·upon the proposed assessment
<br /> for Improvement Project #99-12, which ii the
<br /> Bituminous Paving ol~ iguana Street N~W.
<br /> 'between 1537d Avenue N.W. to 151st Lane
<br />
<br /> The amou~'t to be speda!ly a~s'~s%d
<br />against any particular'lot: piece or parcel of
<br />land is $3,019:40. Affected property owners
<br />may, at any time between September 27 and
<br />November 3, 2000' (prior· to.certiflcation'of.the
<br />assessment to the Anoka County· Auditor), pay
<br />the entire assessment on such property with
<br />interest accrued to the date of payment, to the
<br />City. of Ramsay. No interest shall be charged if
<br />the entire assessment is pale within 30 days
<br />from. the adoption of the assessment, whi(~h s
<br />anticipated to be September 26, 2000.
<br />Affected property owners may at any time
<br />thereafter pay to the City of Ramsay the entire
<br />~m6unt of' the assessment remaining, unpaid,
<br />with interest accrued to December 31 of the~
<br />pe~t succeeding year. if an affected property
<br />owner decides not.to prepay the assessment
<br />before the date given above, the rate of inter-
<br />e~t that will apply is 8.5 percent per year.'The
<br />right to partially prepay the.assessment is not
<br />· available;
<br />· The proposed assessment roll is on file fbr
<br /> pub i'c inspection at the City Administrator's
<br /> office. The total amoun[ of the proposed
<br /> assessment is $784.10. Written or oral objec-
<br /> tiohs will be considered at the hearing. No
<br /> a~'peal may be taken as to the. amount of
<br /> assessment unless a signed, written objection
<br /> L~ !tied With the. City Administrator prior 'to the
<br /> hearing or presented to the presiding officer at
<br /> the hearing, The City Council may upon such
<br /> notice consider any objection to the amount of
<br /> a proposed individual assessment at an
<br /> adjourned hearing upon such further notice to
<br /> the affected property owners' as it d~ems
<br /> advisabte.
<br /> If an' assessment-is ~ontested Or thbre is an
<br /> adjourned'hearing, the fol!0wi~g procedure
<br /> will be followed:
<br /> 1) '[h~ City will present its case first by
<br /> coifing witnesses who may testify, by
<br /> narrative or by examination, and by the
<br /> introduction of exhibits. After such wit-
<br /> 'ness has res{iliad, the cgntesting party
<br />
<br /> will be allowed-to ask. questions. This
<br /> procedure will be repeated with each
<br /> witness until neRher side has further
<br /> questions.
<br /> 2.) After the City has presented all its evi-
<br /> dence, the objector may call witnesses
<br /> or present such testimony as the obiec-
<br /> tor desires. The same procedure for
<br /> questioning of the City's witnesses will
<br /> be followed with the objector's' wit~
<br /> nesses, ' ·
<br />
<br /> 3) The objector may be represented by
<br /> counsel.
<br /> 4) Minnesota Rule.~ of Evidence will not
<br /> be strictly applied; however, they may
<br /> be considered and argued to the
<br /> Council as to the weight of items of evi-
<br /> dence or testimony presented to the
<br /> Council.
<br /> $). The entire proceedings will be record-
<br />
<br /> 6) At the close of' the presentation of evi-
<br /> dence, the obiector may make a. fitial
<br /> presentation to the COuncil based on
<br /> th~ evidence and the law. No new evi-
<br /> dence-may be presented at this point.
<br /> 7) The council may ~dopt the.proposed
<br /> assessment at the h~aring. .
<br /> Under Minnesota Statutes, Sections 435.193:
<br />. to 435.19.5, and Ramsay City Code Chapter
<br /> 4.60.18,. the City Council may defer the pay-
<br /> ment of this special' assessment for any per-
<br /> son(s) that fit the guidelines listed in Section
<br /> 4.60,18.Subd. 5 of the Ramsey City Code.
<br /> When a deferment'of the special assessment
<br /> has been granted and is terminated for any
<br /> reason.provided in these laws, all amounts
<br /> accumulated, including applicable interest,
<br /> will be due. Any assessed property owner
<br /> meeting the requirements of these laws' may,
<br /> within 30 days of the confirmatio~ of the
<br /> assessment, apply-to the City. AdminJstfat'or
<br /> with the preset[bed"form for'such deferral of
<br /> payment of this special assessment.
<br /> An owner may appeal an assessment to
<br />. District Court pursuant to Minnesota Statutes
<br /> Section 429.08q and Chapter 4~60,10 of the
<br /> Ramsey City (~ode by serving notice~of the
<br /> appeal upon the Mayor or City Administrator
<br /> of the Cibj within 30 days after the adoption of
<br /> the assessmeht and filing such notice with the
<br /> District Court within ten days after service
<br /> upon the Mayor or City Administrator.
