TIF program, and he has contacted them about it, but even that will not be a quick move. He
stated that he also remembers hearing that the Planning Commission did not want him back there
asking for more time, and if he gets eighteen months he would not have to do that.
Commissioner Brauer asked what Mr. Guzzo would do if the Planning Commission denies the
request.

Mr. Guzzo indicated he does not know. He stated he does not know how he could move any
faster than eighteen months. He indicated he has been calling the realtor every day. He stated he
would probably have to look for a rental property, but he would still need a permit to do that.
Assistant Community Development Director Frolik stated that if the space rented included this
type of use as an allowable use, a permit reviewed by Planning Commission and Council would
not be needed.
Commissioner Levine questioned if Mr. Guzzo is now in compliance for a home occupation
permit.
Assistant Community Development Director Frolik indicated there were two aspects relating to a
permit. She stated that home occupations are limited to two non-resident employees, and the
business had three, and the second part was having the equipment indoors or screened.
Mr. Guzzo stated that the trucks are either stored inside or moved off the property at night. He
indicated there has been occasion when an employee takes a truck home, and that is how they get
down to two employees. He stated there have been a few times when the truck had to be left
overnight for service or something.
Commissioner Brauer stated he is having trouble computing between the letter they received and
what Mr. Guzzo is stating. He indicated that the letter says there are four work tracks, with one
being a boon truck. He stated they also have many photos from Mr. Villeneuve where you can
see the vehicles. He indicated the letter also says there are four to six people working at the
building.

Mr. Guzzo indicated that he only owns three vehicles, not four. He stated there are only three
employees total, and one of them works from his own home. He indicated that one of the
vehicles listed is a personal vehicle that that person chose to letter with the company logo, but it
is not owned by the company.

Chairperson Nixt asked for clarification on how many people there are working for the company
in total.
Mr. Guzzo stated there are three others and him. He indicated that one is a sales person that
works out of his home, and one is a service person that just picks up the truck and leaves.
Commissioner Shepherd noted that both neighbors commented on garbage on the property.

Planning Commission/December 1, 2005
Page 7 of 10 -33-
