Mr. Foster stated that the plat should only be for Lot 1. <br /> <br />Councihnember Anderson inquired if the Council should wait to take action until an amended <br />plat is received. <br /> <br />City Attorney Goodrich replied that the Council does not need to delay action as long as they feel <br />comfortable with staff's ability to administer the plat as amended. <br /> <br />Councilmember Hendriksen recommended granting final plat subject to City Attorney approval. <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Connolly, to adopt <br />Resolution #00-12-331 granting final plat approval to Holiday Acres contingent upon <br />compliance with City Staff Review Letter dated December 6, 2000 and City Attorney approval <br />as well as entering into a development agreement with the City. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Connolly, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Case #6A: <br /> <br />Adopt Ordinance to Establish Density Transition Standards for New <br />Residential Development <br /> <br />Community Development Director Frolik stated that on November 14, 2000, the City Council <br />introduced an ordinance to establish density transition standards between existing and new <br />residential development. At the time of introduction, the Council requested a work session to <br />review and discuss the details of the ordinance prior to placing the ordinance on a future Council <br />agenda for adoption. At a work session on December 6, 2000, the City Council reviewed the <br />proposed density transition ordinance. The consensus of the City Council was to amend the draft <br />ordinance as follows and place it on the December 12th agenda for consideration: <br /> <br />1. add public parks and trails as possible substitutes for lot tiers or buffer areas; <br />2. provide examples or definition of "existing topographic features"; <br />3. remove the language that would except commercial/industrial property rezoning to <br /> some degree of residential use from the transitioning standards; <br />4. add language that will provide adjacent property owners the opportunity to waive the <br /> requirement for density transitioning. <br /> <br />Councihnember Hendriksen explained that the language was added to give a property owner the <br />right to waive the transitioning requirement based on a hypothetical that was presented that had a <br />property owner that owns five acres and anticipated urban development next to them. With the <br />density transitioning ordinance the neighboring property would be required to develop the land <br />into one acre lots, but if the owner of the five acres was intending on developing his property in <br />the future into an urban development then he could waive the density transitioning requirements. <br /> <br />City Council/December 12, 2000 <br /> Page 16 of 25 <br /> <br /> <br />
