Councilmember Elvig introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION # 05-08-278 <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO <br />KEITH SCHMIDT TO EXCEED THE MAXIMUM SQUARE FOOTAGE ALLOWED FOR <br />ACCESSORY BUILDINGS BASED ON FINDINGS OF FACT #0737 AND DECLARING <br />TERMS OF SAME: <br /> <br /> WHEREAS, Keith Schmidt (Permittee) has properly applied for a conditional use permit to <br />exceed the maximum square footage allowed for accessory buildings for properties between 1 and <br />1.99 acres as established in section 9.11.02 "Accessory Uses & Buildings" of City Code on the <br />property generally known as 8100 151 st Lane NW and legally described as follows: <br /> <br />Lot 4, Block 7, Whispering Pines Estates 2nd, Anoka County, Minnesota <br /> <br />(Subject Property) <br /> <br /> WHEREAS, the Planning Commission met on August 8, 2005, conducted a public <br />hearing and recommended City Council approval of the request; <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />Based on Findings of Fact #0737, a conditional use permit (Permit) to exceed the maximum <br />allowable square footage for accessory building space on properties between 1 and 1.99 acres in <br />size, is hereby granted to Keith Schmidt, hereinafter referred to as the "Permittee". <br /> <br />That the overall square footage for accessory buildings may exceed the 1,664 square foot <br />accessory building size restriction for properties between the size of 1 and 1.99 acres by a total <br />of 580 square feet in order to accommodate the inside storage of private-use equipment and <br />vehicles. <br /> <br />3. That the maximum allowable height of the sidewalls is restricted to ten (10) feet and the overall <br /> mean gable height is restricted to a maximum of sixteen (16) feet. <br /> <br />4. That the construction of the detached accessory building on the Subject Property shall require <br /> issuance of a building permit from the City of Ramsey. <br /> <br />5. That the accessory building shall be properly constructed and maintained in accordance with all <br /> applicable MN State Building Codes. <br /> <br />6. The Permittee herein agrees that no business use will be operated in the detached accessory <br /> building unless such use is permitted in accordance with City Code. <br /> <br />7. That this Permit shall be perpetual in duration as long as the terms are herein complied with. <br /> <br /> <br />
