Councilmember Kurak introduced the following resolution and moved for its adoption: RESOLUTION #03-03-069 RESOLUTION APPROVING THE ISSUANCE OF AN INTERIM USE PERMIT FOR OUTSIDE STORAGE OF COMMERCIAL VEHICLES AND EQUIPMENT ON A RESIDENTIALLY ZONED PARCEL, BASED ON FINDINGS OF FACT #0644, AND DECLARING TERMS OF THE SAME. WHEREAS, Gerald Bauer, hereinafter referred to as "Permittee", has properly applied to the City of Ramsey (the "City") for an Interim Use Permit to allow outside storage of commercial vehicles and equipment on the property generally known as 16130 Variolite Street and legally described as follows: The Southwest Quarter of the Northeast Quarter and the Northwest Quarter of the Southeast Quarter in Section 16, Township 32, Range 25, Anoka County, Minnesota. (the "Subject Property"); and WHEREAS, the Planning Commission met on February 6, 2003, conducted a public hearing and recommended City Council denial of the request; and WHEREAS, the City Council met on February 25, 2003, and directed City Staff to prepare findings of fact to support approval of the request for IUP; and WHEREAS, the City Council met on March 11, 2003, adopted Findings of Fact #0644 and approved the request for an IUP. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: This permit is issued pursuant to Section 9.03.04A of the Ramsey City Code. The conditions of this permit are as follows: 1) The Permittee is hereby granted permission to storage commercial vehicles and equipment on the Subject Property for a period not to exceed twenty-four months. The term of the permit shall be from March 12, 2003 to March 12, 2004. 2) All outside storage of vehicles and equipment shall be in an orderly fashion on 2-inch Class 5 surface. The number of vehicles and equipment is limited to 5 dump trucks, 1 company truck, 1 bobcat, 1 paving machine, 2 rollers, and 3 trailers. 3) No vehicles or equipment shall be started prior to 6:00 a.m. and no vehicles may return to the Subject Property after 7:00 p.m., Monday through Saturday. 4) The access shall be surfaced with a 2-inch Class 5 surface from the Variolite Street entrance to the area of the Subject Property containing the interim use activity.
