NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />1. Based on Findings of Fact #0666, an Interim Use Permit (Permit) to allow for outside storage <br /> of commercial equipment in the front yard of a residential property is hereby granted to Jeff <br /> and Barbara Rockow, hereinafter referred to as the "Permittee". <br /> <br />2. The Permittee is herein allowed to store a maximum of two (2) commercial trailers in an <br /> orderly manner within a confined area in the northwest comer of the front yard on the Subject <br /> Property. The trailers shall remain in close proximity to both the established evergreen trees <br /> as well as the five (5) recently planted evergreen trees to ensure maximum screening from <br /> other properties. See exhibit A (aerial photo). <br /> <br />3. The Permittee herein agrees that no stockpiling of materials, such as scrap aluminum and <br /> other debris, shall be allowed on the Subject Property. <br /> <br />4. The Permittee herein agrees that the two commercial trailers will be stored on grass and the <br /> area will be mowed and/or trimmed on a regular basis to ensure the area remains well- <br /> manicured. <br /> <br />5. The Permittee herein agrees that the two commercial trailers will be kept neat in appearance <br /> and will remain in a working order. <br /> <br />6. This Permit shall commence on the date of City Council approval of same and shall expire on <br /> March 23, 2009. <br /> <br />7. This Permit is applicable only to the outdoor storage of a maximum of two (2) commemial <br /> trailers in the northwest comer of the property and the use of this area of the property for the <br /> outdoor storage of any other items is prohibited. <br /> <br />8. This Permit shall become null and void in the event that outside storage of the trailers ceases <br /> for six (6) consecutive months prior to the expiration date or upon the expiration date, <br /> whichever occurs first. Both commercial trailers must be removed from the Subject Property <br /> or relocated to comply with City Code requirements within sixty (60) days of the date of <br /> termination or the expiration date of the Permit, whichever occurs first. In the event the <br /> Permittee fails to perform said timely removal or relocation, the Permittee herein grants the <br /> City authority to remove said items from the Subject Property at the Permittee's expense. <br /> <br />9. That all costs incurred by the City in administering and enforcing this Permit shall be the <br /> responsibility of the Permittee. <br /> <br />10. That the City Administrator or his or her designee shall have the right to inspect the Subject <br /> Property for compliance and safety purposes at any time. <br /> <br />11. That if any provision of this Permit shall be declared void or unenforceable, the other <br /> provisions shall not be affected but shall remain in full force and effect. <br /> <br />RESOLUTION #04-03-077 <br />Page 2 of 4 <br /> <br /> <br />
