SECTION <br /> <br />VIOLATION AND PENALTY. <br /> <br /> Subd. 1. It is unlawful for any resident to fail to separate <br />recyclable materials which may be or may accumulate upon property <br />owned or occupied, in accordance with the provisions of this <br />ordinance. <br /> <br /> Subd. 2. Any persons found in violation of any provisions of <br />this ordinance will, upon first offense, be warned by tag placed on <br />container containing unseparated mixed municipal waste. Upon second <br />offense, a letter of violation shall be sent to the violator. Upon <br />the third offense, a police citation will be given. Violator's fine <br />shall not exceed $700.00. <br /> <br /> Subd. 3. Any person violating any provisions of this chapter is <br />guilty of a misdemeanor and upon conviction will be punished as <br />provided for by City Ordinance Section <br /> <br />SECTION ENFORCEMENT. It is the duty of the Code Enforcement <br />Officer to enforce the provisions of this ordinance. <br /> <br />SECTION SEVERABILITY. It is hereby declared to the the <br />intention of the city that the several provisions of this ordinance <br />are severable in accordance with the following: <br /> <br /> Subd. 1. If any court of competent jurisdiction shall adjudge <br />any provision of this ordinance to be invalid, such judgment shall not <br />affect any other provision of this ordinance not specifically included <br />in said judgment. <br /> <br />SECTION PROVISIONS ARE ACCUMULATIVE. The provisions of this <br />Ordinance are accumulative to all other laws, ordinances and <br />regulations heretofore passed, or which may be passed hereafter, <br />covering any subject matter in this Ordinance. <br /> <br />SECTION EFFECTIVE DATE. This ordinance becomes effective <br />upon its passage and publication according to law.
