SECTION VIOLATION AND PENALTY. Subd. 1. It is unlawful for any resident to fail to separate recyclable materials which may be or may accumulate upon property owned or occupied, in accordance with the provisions of this ordinance. Subd. 2. Any persons found in violation of any provisions of this ordinance will, upon first offense, be warned by tag placed on container containing unseparated mixed municipal waste. Upon second offense, a letter of violation shall be sent to the violator. Upon the third offense, a police citation will be given. Violator's fine shall not exceed $700.00. Subd. 3. Any person violating any provisions of this chapter is guilty of a misdemeanor and upon conviction will be punished as provided for by City Ordinance Section SECTION ENFORCEMENT. It is the duty of the Code Enforcement Officer to enforce the provisions of this ordinance. SECTION SEVERABILITY. It is hereby declared to the the intention of the city that the several provisions of this ordinance are severable in accordance with the following: Subd. 1. If any court of competent jurisdiction shall adjudge any provision of this ordinance to be invalid, such judgment shall not affect any other provision of this ordinance not specifically included in said judgment. SECTION PROVISIONS ARE ACCUMULATIVE. The provisions of this Ordinance are accumulative to all other laws, ordinances and regulations heretofore passed, or which may be passed hereafter, covering any subject matter in this Ordinance. SECTION EFFECTIVE DATE. This ordinance becomes effective upon its passage and publication according to law. Passed by the City Council of Ramsey, Minnesota this day of , 198__.
