10 Minutes Case t~ 10 <br /> <br /> CONDITIO~SE PERMIT AMENDMENT <br />ROGER HURD - USED VEHICLE SALES LOT <br /> <br />By: Merland Otto, Acting Zoning Administrator <br /> <br />As you will recall, the city Council approved a CUP for Mr. Hurd at <br /> · n <br />the intersectlo of Co. Rd. 56 and Hwy. 10. The CUP is attached. <br />On September 6, 1988, the City Attorney sent a letter (attached) to <br />Mr. Hurd notifying him that he was not in compliance with the terms of <br />the CUP. I have since met with Mr. Hurd, and believe that we have <br />come to a resolution regarding the access to the property. The 27' <br />dedication of right-of-way along Co. 56 is a problem since Mr. Hurd <br />holds a one year lease and bituminous parking lot was installed inside <br />the 27' R.O.W. A possible solution is to defer dedication of the <br />R.O.W. until such time as the R.O.W. is needed for roadway <br />improvements. This could further, be assured if the owner would agree <br />to a covenant stating such intent. <br /> The CUP would have to be amended to reflect such an agreement. <br /> <br />Council Action: <br /> <br />Will be based on your discussion. <br /> <br />Review Checklist: <br /> <br />Administrator X <br />Attorney X <br />Engineer X. <br />Comm.
