ORDINANCE NO. 88- <br /> <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />AN ORDINANCE PROHIBITING THE REMOVAL OF MATERIALS SET OUT FOR <br />RECYCLING COLLECTION AND PROVIDING PENALTIES <br /> <br />The city of Ramsey does ordain: <br /> <br /> Scavenging of Recyclable Materials Prohibited <br /> (1) Purpose. This Section is designed to prevent the <br />unauthorized collections of recyclable materials which are set out as <br />part of a designated recycling program. Unauthorized collection or <br />,'scavenging" may reduce the volume of material collected as part of a <br />designated program and thereby threaten the economic liability of the <br />authorized program. Scavenging may also cause confusion among <br />participating residents and thereby disrupt the publicity and <br />educational processes of an authorized program. This section is also <br />designed to insure that a designated recycling program will be <br />implemented in an orderly fashion to avoid adverse effects on the <br />public health, welfare, safety and environment. <br /> <br /> (2) Definitions. <br /> (a) ,,Authorized Recycling Program" shall mean a program <br /> for the collection and recycling of recyclable materials which <br /> is instituted, sponsored, authorized or controlled by the city <br /> of Ramsey. <br /> (b) ,,Recyclable Materials" shall mean all items of refuse <br /> designated by the City Administrator to be a part of an <br /> authorized recycling program and which are intended for <br /> transportation, processing and remanufacturing or reused. <br /> (c) "Scavenging" shall mean the unauthorized collection <br /> of recyclable materials that have been set out by residents of <br /> the city specifically for participating in curbside recycling <br /> programs. <br /> <br /> (3) Designation of Items. Items designated for recycling shall <br /> be listed by the City Administrator to be part of an authorized <br /> recycling program.. <br /> <br /> (4) Ownership of Recyclable Materials. Ownership of <br /> recyclable materials set out for the purpose of participating <br /> curbside recycling programs shall remain with the person who <br /> set out the materials until removed by the authorized <br /> collector, the person who set out the materials is totally <br /> responsible for their proper preparation, handling and storage. <br /> Ownership and responsibility for the proper handling of the <br /> recyclable materials shall vest in the authorized collector <br /> upon removal thereof by the collector. <br /> <br /> <br />
