5 Minutes <br /> <br />CASE ~ 4 <br /> <br /> REQUEST TO VACATE DRAINAGE <br />EASEMENT ON LOT 4t BLOCK 4, NORTHFORK <br />Case of Mr. Dennis Peck <br /> <br />By: Pete Raatikka, city Engineer <br /> <br />Background: <br />Mr. Dennis Peck, North Fork Inc., is req~/esting that a portion of the <br />drainage easement on the front (North) half of Lot 4, Block 4 be <br />vacated and/or relocated to Lots 3 or 5, Block 4. <br />This drainage easement was provided after the plat was filed to <br />accomodate runoff from several adjacent lots. Consequently, it was <br />not shown on the plat or the Certificate of survey and a building <br />permit was issued for a house. This house is located on the front <br />half of Lot 4 as shown on the enclosed Certificate of Survey. <br />We are in the process of surveying the lot to determine where the <br />drainage easement should be relocated to. Mr. Peck has agreed to <br />provide adequate drainage for the area on Lots 3 or 5 or any portion <br />of Lot 4 which would not affect the building. <br /> I will have a proposed plan to accomodate the drainage available at <br /> the September 27, 1988 council meetinq. <br /> <br />Recommendation: <br />I would recommend that the city Council vacate the portion of the <br />drainage easement on Lot 4, Block 4 which impacts the existing <br />building.. <br /> <br />Council Action: <br />Motion to vacate the portion of the drainage easement on Lot 4, Block <br />4 Northfork which impacts the existing building contingent on the <br />developer providing adequate drainage easements to accomodate the <br />drainage. <br /> <br />Review Checklist: <br /> <br />Administrator <br />Attorney <br />Engineer <br />Comm.
